Airports Authority of India Updates Annual Reporting and Financial Statement Rules

The Central Government issued the Airports Authority of India (Annual Report and Annual Statement of Accounts) Rules, 2014, a new set of delegated legislation that came into force on March 27, 2014, upon its publication in the Official Gazette. These rules were enacted in exercise of the powers conferred by clauses (g) and (h) of sub-section (2) of section 41 of the Airports Authority of India Act, 1994 (Act 55 of 1994). The issuance of these rules superseded the previous Airports Authority of India (Annual Report and Annual Statement of Accounts) Rules, 2008, with the explicit exception of actions already taken or omitted under the earlier framework. The primary objective of this supersession was to establish a revised and updated framework for the financial and operational reporting of the Airports Authority of India (AAI), the statutory body responsible for managing civil aviation infrastructure in India.
Under the new rules, the Airports Authority of India is mandated to prepare its Annual Statement of Accounts, which includes a statement of profit and loss account and a balance sheet, by June 30th of each year. These financial statements, specified in Form I and Form II annexed to the rules, must be submitted to the Comptroller and Auditor General of India (C&AG), the supreme audit institution of India, by July 31st annually, after being duly authenticated and passed by the Authority. The legislation provided: “The Authority shall prepare its Annual Statement of Accounts including the statement of profit and loss account and balance sheet showing the financial results as specified in Form I and Form II, respectively ,by 30th June each year and submit the same, duly authenticated by the authorised signatory and duly passed by the Authority, to the Comptroller and Auditor General of India, not later than the 31st July of every year.” A provision allows the Central Government, in consultation with the C&AG, to extend this submission deadline for recorded reasons. Following certification by the C&AG, the Annual Statement of Accounts, along with the audit report, must be forwarded to the Central Government within three months of its submission to the C&AG. Additionally, the Authority is required to prepare and submit an Annual Report, detailing its activities during the financial year and outlining prospective activities for the subsequent year, to the Central Government before December 1st. This report, whose form is specified in Form III, can also have its submission date extended by the Central Government upon request from the Authority, provided reasons are recorded.
The legislative intent behind the 2014 Rules was to enhance transparency, accountability, and standardization in the financial and operational reporting of the Airports Authority of India. The earlier legal position, governed by the 2008 Rules, was deemed to require an update to align with contemporary accounting practices and reporting standards. By superseding the previous rules, the new framework aimed to address any statutory gaps or limitations that may have existed, ensuring a more robust and comprehensive reporting mechanism. The rules introduce specific formats for the balance sheet (Form I), profit and loss statement (Form II), and the content of the Annual Report (Form III), thereby standardizing the presentation of financial results and operational summaries. These detailed requirements ensure that all relevant financial data, including reserves, borrowings, assets, liabilities, and various revenue streams like airport navigational services and non-aeronautical services, are systematically reported. The enforcement mechanism is clearly defined, involving the C&AG for audit and certification, and the Central Government for overall oversight and policy guidance, ensuring adherence to the prescribed timelines and formats. This structured approach aims to provide a clearer picture of the AAI's financial health and operational performance to stakeholders, including the government and the public.
