Ammonium Nitrate Rules Amended to Extend Specified Financial Year Periods

The Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) issued a notification on April 17, 2025, introducing the Ammonium Nitrate (Amendment) Rules, 2025. This delegated legislation, published as G.S.R. 239 (E), modified the existing Ammonium Nitrate Rules, 2012. The amendment followed the publication of a draft notification, G.S.R. 31 (E), on January 13, 2025, which invited objections or suggestions from the public for a period of thirty days. The amendments were enacted by the Central Government in exercise of the powers conferred by section 5 of the Explosives Act, 1884. The Ammonium Nitrate (Amendment) Rules, 2025, came into force on April 17, 2025, the date of their publication in the Official Gazette.
The primary change introduced by the 2025 amendment concerns the duration of certain specified periods within the principal rules. Specifically, rule 32 of the Ammonium Nitrate Rules, 2012, which previously referred to "five financial years," was amended to substitute this phrase with "ten financial years." Similarly, sub-rule (1) of rule 36 of the said rules also saw the phrase "five financial years" replaced by "ten financial years." This alteration effectively doubles the duration of these specified periods, impacting compliance and regulatory frameworks for entities involved with ammonium nitrate. The principal rules were originally published on July 11, 2012, and had undergone subsequent amendments in 2013, 2018, and 2021.

The amendment does not introduce new enforcement mechanisms or statutory timelines beyond the extended periods themselves.
