Assam Amends Rules Governing Tenure and Re-appointment of College Principals

The Governor of Assam, through a notification issued by the Higher Education Department on October 29, 2025, introduced The Assam College Employees (Provincialisation) (Amendment) Rules, 2025. These rules, which came into force on October 30, 2025, upon their publication in the Official Gazette, further amend the existing Assam College Employees (Provincialisation) Rules, 2010, referred to as the Principal Rules. The amendments were enacted in exercise of powers conferred under Sub-Section (1) of section 12 of the Assam College Employees (Provincialisation) Act, 2005, and primarily focus on modifying the provisions related to the tenure and re-appointment of Principals in colleges covered under the Act. The changes aim to refine the process for extending service and re-applying for the Principal's post, impacting the administrative structure and leadership of provincialised colleges across the state.

The amendments specifically target Rule 5, sub-rule (1), clause (iii) of the Principal Rules. Under the revised framework, sub-clause (b) has been substituted to clarify the eligibility criteria for Principals seeking further terms. The legislation provided: “After completion of the initial term of five years, the Principal shall be eligible for applying for a further period of one or more term of five years in any College, if his age permits and subject to the satisfactory performance report from the Government. In such cases, the post of Principal shall be advertised for filling up before the term of existing Principal is over.” This change allows a Principal, after completing an initial five-year term, to apply for subsequent five-year terms in any college, provided they meet age requirements and have a satisfactory performance record from the Government. Crucially, it mandates that the Principal's post must be advertised before the incumbent's term concludes. Furthermore, sub-clause (c) has been substituted to address the tenure of Principals nearing superannuation. It stipulates that Principals who do not have sufficient service period remaining for a full five-year extension may, subject to a satisfactory performance report from the Government, have their tenure extended for the remaining period of service until their superannuation, and not otherwise.

The legislative intent behind these amendments appears to be the establishment of a more structured and performance-driven system for the appointment and extension of college Principals. By allowing Principals to apply for further terms in "any College," the rules introduce greater flexibility and potentially broader opportunities for experienced administrators, while also ensuring a competitive selection process through mandatory advertisement of the post. The policy rationale also addresses a previous statutory gap concerning Principals who are close to their retirement age, providing a clear mechanism for short-term extensions based on performance, thereby ensuring continuity in leadership without granting full five-year terms where service period is insufficient. These changes are designed to streamline administrative procedures, promote accountability through performance evaluations, and ensure that leadership positions in provincialised colleges are filled efficiently and transparently, aligning with the broader objectives of the Assam College Employees (Provincialisation) Act, 2005, which brought these colleges under government purview.
