Assam Government Halts New Proposals Under Trade Development Fund

The Government of Assam, through a Notification issued by its Finance (Taxation) Department on November 11, 2025, formally ceased the consideration of new proposals and bills under the Assam Trade Development Fund (ATDF). This significant directive, published in The Assam Gazette Extraordinary, addressed the operational implications arising from the discontinuation of the fund's primary revenue source. The ATDF was originally established in Assam on July 24, 2008, pursuant to the provisions of Section 10 of the Assam Entry Tax Act, 2008. Under this framework, the proceeds from Entry Tax, after deducting collection costs, were credited to the fund. Rule 11 of the Assam Entry Tax Rules, 2008, further stipulated that these tax collections were to be deposited into a distinct and exclusive Head of Account, 0042-106 - Tax on Entry of Goods into Local Area, which constituted the ATDF. However, with the nationwide implementation of the Goods and Services Tax (GST) regime from July 1, 2017, Entry Tax was subsumed under GST, thereby discontinuing the inflow of funds to the Assam Trade Development Fund. Consequently, the notification stipulated that no further proposals or bills under the ATDF would be considered after its date of issue. Any pending liabilities related to the fund would henceforth be accommodated from the budgets of the respective Implementing Departments. The notification came into force upon its publication on November 11, 2025.

The legislative intent behind this notification was to provide clarity and formal closure to the operational aspects of the Assam Trade Development Fund, whose primary funding mechanism had become defunct. The earlier legal position saw the ATDF as a dedicated financial resource for infrastructure development and amenities aimed at facilitating trade, commerce, and intercourse within Assam, as mandated by the Assam Entry Tax Act, 2008. The statutory gap addressed by this notification was the absence of a clear directive on the fund's future operations and the management of existing commitments following the cessation of its funding source. By issuing this notification, the government aimed to streamline administrative processes and ensure that financial responsibilities for ongoing projects or liabilities previously earmarked for the ATDF were appropriately reallocated. The legislation provided: “It is hereby notified that no further proposals or bills under the Assam Trade Development Fund shall henceforth be considered after the date of issue of this notification. Any pending liability shall be accommodated from the budget of Implementing Departments.” This measure ensures fiscal prudence and prevents the accumulation of unfunded proposals under a mechanism that no longer receives revenue. While the notification does not introduce new rights or obligations, it effectively amends the operational scope of the ATDF by ceasing its ability to entertain new financial commitments, thereby adapting the statutory framework to the changed tax landscape post-GST implementation.
