Assam Legislature Authorises Further Expenditure for Current Financial Year

The Assam Appropriation (No. III) Act, 2025, an Act of the Assam Legislative Assembly, received the assent of the Hon'ble Governor of Assam on December 1, 2025, and was subsequently published for general information on December 3, 2025. This legislative instrument was enacted to authorise the payment and appropriation of certain further sums from and out of the Consolidated Fund of the State of Assam for the services required during the financial year 2025-26. The Act specifically permits the withdrawal of a substantial amount, aggregating to Rupees Eighteen Thousand Eight Hundred And Ninety Seven Crore Eighty Two Lakh Forty Five Thousand (Rs. 18897,82,45,000.00), to meet various charges that will arise in the course of payment for the specified financial year. These funds are allocated across numerous government services and purposes, as detailed in the Schedule appended to the Act, covering both revenue and capital expenditures. The legislation came into force upon its publication in the Official Gazette.

The primary aim of the Assam Appropriation (No. III) Act, 2025, is to provide the necessary legal sanction for the state government to incur additional expenditure beyond what was initially approved, ensuring the uninterrupted functioning of public services and developmental activities. The policy rationale behind such an appropriation act is rooted in the constitutional requirement that no money can be drawn from the Consolidated Fund of the State (the principal account of the government) without legislative authority. This Act addresses the statutory gap that would otherwise exist if additional financial requirements arose during the financial year that were not covered by previous appropriation acts. The legislation provided: "From and out of the Consolidated Fund of the State of Assam there may be paid and applied sums not exceeding those specified in column (3) of the Schedule amounting in the aggregate to the sum of Rupees Eighteen Thousand Eight Hundred And Ninety Seven Crore Eighty Two Lakh Forty Five Thousand towards defraying the several charges which will come in course of payment during the financial year 2025-26 in respect of the services specified in column (2) of the Schedule." This provision is central to the Act, empowering the state to meet its financial obligations. The sums authorised by this Act are to be appropriated for the services and purposes outlined in the Schedule for the year ending on March 31, 2026. The Schedule distinguishes between sums "Voted by the Assembly" (requiring legislative approval) and those "Charged on the Consolidated Fund" (expenditure not subject to annual vote, such as salaries of constitutional officeholders), ensuring transparency and adherence to financial procedures.
