Bank of Baroda Revises Officers' Service Regulations, Pay Scales, and Allowances

The Bank of Baroda, through a notification issued by its HRM Department, published the Bank of Baroda (Officers') Service (Amendment) Regulations, 2020, in the Gazette of India on March 31, 2020. These regulations were enacted by the Board of Directors under powers conferred by section 19, read with sub-section (2) of section 12 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970, following consultation with the Reserve Bank of India and with the prior sanction of the Central Government. The amendments primarily update and revise various service conditions, emoluments, and benefits for the bank's officers. While published on March 31, 2020, many provisions of these regulations were deemed to have come into force retrospectively from November 1, 2012, with other specific provisions taking effect from May 1, 2010, June 1, 2015, May 1, 2015, May 25, 2015, or March 31, 2020.
The amendments introduced significant changes across various aspects of officer service. The definition of "family" was expanded to include wholly dependent physically and mentally challenged siblings, widowed, divorced, or separated daughters, and sisters, along with provisions for married female officers to include natural parents or parents-in-law. Revised pay scales were introduced for all grades, from Junior Management Grade Scale I to Top Executive Grade Scale VII, effective from November 1, 2012, with a new Scale VIII for Chief General Managers effective from March 31, 2020. A Special Allowance was also introduced, ranging from 7.75% to 11% of Basic Pay plus Dearness Allowance, depending on the officer's scale. The regulations also detailed revised increment structures, including stagnation increments for officers reaching the maximum of their scales, and updated Professional Qualification Pay rates. Fixed Personal Pay, along with House Rent Allowance, was also revised and frozen for the entire service period for eligible officers. The categorization of posts within the bank was explicitly defined, linking specific roles like Chief General Manager, General Manager, and Manager to their respective grades and scales.
The legislative intent behind these amendments was to provide updated and beneficial provisions for the officers. The Explanatory Memorandum accompanying the regulations clarified this, stating: "The retrospective effect given in these regulations relate to the pay and other allowances and benefits to the officers of the Bank of Baroda and are essentially beneficial legislation. Hence, giving retrospective effect to the said provisions of these regulations will not adversely affect the interest of any person as a result of such retrospective application." This rationale underscores the policy to improve the compensation and working conditions for the bank's workforce. The earlier legal position was governed by the Bank of Baroda (Officers') Service Regulations, 1979, which these new regulations extensively amend and substitute. The amendments addressed statutory gaps and limitations by updating Dearness Allowance calculations, House Rent Allowance entitlements, and various other allowances such as City Compensatory Allowance, Special Areas Allowances for specific geographical regions like Mizoram, Nagaland, and parts of Jammu and Kashmir and Himachal Pradesh, and Project Area Compensatory Allowance. New provisions were introduced for mid-academic year transfer allowance and deputation allowance. Medical expense reimbursement limits were increased, and a Medical Insurance facility was introduced. Leave policies saw substantial changes, including an increase in Privilege Leave accumulation and encashment limits, the introduction of Special Sick Leave for organ donation, and new provisions for childless female officers adopting a child, biological mothers in surrogacy cases, and paternity leave for male officers. Travel entitlements for officers were also revised, specifying modes of transport and per diem Halting Allowance rates based on grade and location, alongside lump sum amounts for transfer expenses and updated Leave Travel Concession rules.
