Central Government Amends Water Pollution Rules to Redefine White Category Industrial Sectors

The Ministry of Environment, Forests and Climate Change issued a significant notification on July 28, 2025, amending the regulatory framework governing industrial water pollution. This legislative instrument, designated as G.S.R. 511(E), was promulgated in exercise of the powers conferred by the proviso to sub-section (1) of section 25 of the Water (Prevention and Control of Pollution) Act, 1974. The notification sought to modify the previous government order dated November 12, 2024, specifically regarding the classification of industrial sectors that pose minimal environmental risk. By substituting paragraph (a) and the entire Schedule of the earlier notification, the Central Government, acting in consultation with the Central Pollution Control Board, introduced a revised list of "White Category" industries. These are sectors characterized by a pollution index score a metric used to categorize industries based on their emissions, effluents, and hazardous waste generation of 25 or less. The legislation came into force upon its publication in the Official Gazette on July 29, 2025.

The primary legal consequence of this amendment is the streamlining of compliance for 54 specific industrial sectors and activities. Under the revised rules, these entities are exempted from the standard "Consent to Establish" and "Consent to Operate" requirements, provided they adhere to a simplified notification process. The legislation provided: “all industrial sectors or projects or processes or activities having pollution index score upto 25 as listed in the Schedule to this notification, subject to condition that such industrial sectors or projects or processes or activities shall inform in writing to the State Pollution Control Boards or the Pollution Control Committees;” This shift emphasizes a transition toward a self-regulatory regime where the obligation of the industry is limited to providing a written intimation to the relevant State Pollution Control Board or Pollution Control Committee.

The legislative intent and policy rationale behind this amendment are rooted in the objective of promoting the "Ease of Doing Business" while maintaining environmental oversight. By identifying sectors with negligible pollution footprints, the government aimed to reduce the administrative and procedural burden on small-scale and eco-friendly enterprises. The earlier statutory framework often subjected these low-impact industries to the same rigorous scrutiny as more hazardous sectors, leading to unnecessary delays and resource expenditure. The revised Schedule now encompasses a broad spectrum of activities, ranging from the assembly of bicycles and air conditioners to the production of bio-fertilizers and bio-pesticides without inorganic chemicals. It also specifically includes essential medical supplies such as medical oxygen and the manufacturing of scientific and mathematical instruments.

Furthermore, the notification addresses statutory gaps by incorporating the latest classifications determined by the Central Pollution Control Board in 2025. It clarifies the status of various modern industrial processes, such as hydrogen production through electrolysis using renewable energy and the operation of compressed bio-gas plants using municipal solid waste or agro-residues. The amendment also covers green energy initiatives, including solar photovoltaic power, wind power, and mini hydel power plants with a capacity of up to 25 megawatts. By substituting the prior Schedule, the government has ensured that the law reflects current technological advancements and industrial practices. The enforcement mechanism remains cantered on the mandatory written disclosure, ensuring that state authorities retain a record of industrial activities while facilitating a more efficient regulatory environment for non-polluting sectors.
