Central Government Appoints Collector of Katni as Arbitrator for Special Railway Project in Madhya Pradesh

The Ministry of Railways, acting through the West Central Railway’s Construction Organisation, issued a formal notification on November 27, 2025, regarding the administrative and legal oversight of a significant infrastructure development in Madhya Pradesh. This statutory instrument, identified as S.O. 5463(E), announced the appointment of a dedicated arbitrator to oversee matters related to a Special Railway Project. The project involves the construction of a Road Over Bridge (ROB) intended to replace Level Crossing No. 353, located at KM 1075/7-8 between the Niwar and Katni stations on the Itarsi-Katni rail section. Under the authority of the Railway Act, 1989, the Central Government designated the Collector of Katni to serve as the arbitrator for this initiative. The appointment was mandated to take effect immediately upon the notification's publication in the Gazette of India, ensuring that the legal framework for the project’s execution was established without delay.

The legislation provided: “In exercise of the powers conferred by clause (6) of section 20 F of the Railway Act, 1989 (Railway Amendment Act, 2008), the Central Government, hereby appoints the arbitrator mentioned in column (2) of the table below to perform the functions as such authority under the said Act... for the purpose of execution, maintenance, management and operation of such Special Railway Project.”

The primary policy rationale behind this notification was to facilitate the seamless execution, maintenance, and management of the Road Over Bridge project. By appointing the District Collector as the arbitrator (a quasi-judicial official appointed to resolve disputes), the government established a localized mechanism to handle legal and procedural issues, particularly those concerning land valuation or compensation claims that frequently arise during railway expansions. This move addressed the statutory necessity of having a competent authority to perform functions under Section 20F of the Act, which deals with the determination of amounts payable as compensation for land acquired for special railway projects. The jurisdiction of this specific appointment was confined to the Murwara Tehsil within the Katni District of Madhya Pradesh.

Prior to this notification, the legal framework required the formal designation of an authority to ensure that the Special Railway Project complied with the enhanced procedural requirements introduced by the Railway Amendment Act, 2008. This amendment was originally enacted to expedite projects of national importance by streamlining land acquisition and dispute resolution processes. The transition from a level crossing to a Road Over Bridge is a critical safety measure, aimed at eliminating operational bottlenecks and reducing the risk of accidents at the intersection of rail and road traffic. By invoking these specific statutory powers, the Ministry of Railways ensured that the construction between Niwar and Katni stations would proceed under a clear enforcement mechanism, providing affected parties with a defined statutory timeline and a specific authority for the adjudication of grievances.
