Central Government Declares Land Acquisition for Eastern Dedicated Freight Corridor in Dhanbad

The Ministry of Railways, through the Eastern Railway’s Construction Department, issued a formal notification under the Railways (Amendment) Act, 2008, to finalize the acquisition of land in the Dhanbad district of Jharkhand. This statutory instrument, identified as S.O. 1216(E) and dated March 13, 2025, was published in the Gazette of India on March 17, 2025. The declaration marked the culmination of a legal process initiated to facilitate the execution, maintenance, management, and operation of a Special Railway Project known as the Eastern Dedicated Freight Corridor, which has since been redesignated as the Multi-tracking of Son Nagar Andal. The acquisition was necessitated by the Central Government’s strategic requirement to expand rail infrastructure for high-capacity freight movement.

The procedural history of this acquisition began with a preliminary notification issued on March 28, 2024, under Section 20A of the Railways (Amendment) Act, 2008, which declared the government’s intent to acquire specific land parcels. Following the statutory mandate, the substance of that notification was published in local newspapers, including the Hindi daily Dainik Jagran and the English daily The Times of India, on April 9, 2024. The competent authority reported that no objections were received from any persons interested in the land during the prescribed period. Consequently, after reviewing the report submitted by the competent authority, the Central Government exercised its powers to issue this final declaration.

The legislation provided: “on publication of this notification in the official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.”

This declaration carries significant legal consequences for the recorded owners and the nature of the property rights involved. By invoking Section 20E of the Act, the government ensured that the identified land specifically located in the Kaliasol Circle and Mauza Bara Ambona of Dhanbad is now legally transferred to the Union. The land in question comprises approximately 0.3570 acres of Raiyati Goda-1 type land (privately owned agricultural land of a specific grade). The statutory framework of the Railways (Amendment) Act, 2008, was designed to streamline the land acquisition process for essential infrastructure projects, addressing previous delays in rail expansion by providing a clear mechanism for the vesting of land (the process by which land ownership is settled in an entity) once the public notice and objection phases are concluded.

The policy rationale behind this notification is rooted in the legal necessity to secure unencumbered land for the Dedicated Freight Corridor, a project of national importance aimed at decongesting the existing rail network. Under the prior statutory framework, land acquisition for railways often faced prolonged litigation; however, the current enforcement mechanism under Section 20E ensures that once the declaration is gazetted, the Central Government acquires absolute title. This allows the Ministry of Railways to proceed with the construction and multi-tracking of the Son Nagar Andal section without the risk of subsequent claims hindering the project’s timeline. The notification effectively substitutes the private rights of the recorded owners with a right to compensation as per the prevailing law, while the physical and legal control of the plot passes to the Eastern Railway’s Construction Department.
