Central Government Designates Competent Authorities and Arbitrators for Special Railway Projects

The Ministry of Railways issued a significant notification, S.O. 677(E), on February 10, 2025, formally designating specific officers to act as 'Competent Authority' and 'Arbitrator' for various Special Railway Projects across the country. This executive instrument, published in the Gazette of India, came into force upon its publication, aiming to facilitate the efficient execution, maintenance, management, and operation of critical railway infrastructure. The notification was issued by the Central Government in exercise of the powers conferred by clause (6) of section 20F and clause 7A of section 2 of the Railway Act, 1989 (24 of 1989), which provides the statutory framework for such designations.

The primary objective of this notification is to streamline the administrative and dispute resolution processes associated with Special Railway Projects, which are vital for enhancing India's rail network. By clearly identifying the 'Competent Authority' (an officer empowered to make decisions or take actions under the Act) and the 'Arbitrator' (an independent person appointed to settle disputes), the government seeks to ensure clarity of roles and expedite project implementation. The earlier legal position, while providing the overarching framework through the Railway Act, 1989, necessitated specific executive orders like this notification to operationalize the appointment of these authorities for individual projects. This addresses potential statutory gaps or ambiguities regarding who holds specific powers for particular projects, thereby preventing delays and ensuring smooth project progression. For instance, in the case of the "Construction of 2 lane ROB in lieu of LC No. 18 at Navalgund Road - Annigeri Ch: 34/700-800 (Annigere Village)" project in Dharwad district, the Assistant Commissioner, Dharwad, was designated as the Competent Authority, and the Regional Commissioner, Belgavi, as the Arbitrator. This precise designation ensures that local administrative leadership is directly involved in overseeing and resolving issues related to the project. The legislation provided: “…the central government hereby authorizes the officers mentioned in column (4) of the table below as 'Competent Authority' and the officers mentioned in column (5) of the table below as 'Arbitrator' to perform the functions as such authority under the said act with effect from date of publication of this notification in the official gazette in respect of Special Railway Projects mentioned in column (2) relating to district mentioned in column (3) of the table below for public purpose of execution, maintenance, management and operation of such Special Railway Project.” This measure is intended to enhance the efficacy of project delivery by establishing clear lines of authority and a defined mechanism for dispute resolution, thereby supporting the broader policy rationale of robust infrastructure development.
