Central Government Designates Competent Authorities for Madhya Pradesh Railway Project Land Acquisition

The Ministry of Railways issued Notification S.O. 595(E) on February 3, 2025, formally designating specific officers as Competent Authorities for land acquisition related to a crucial railway infrastructure project in Madhya Pradesh. This notification, published in the Gazette of India, came into force upon its publication, establishing the legal framework for the acquisition process. The primary objective of this issuance was to facilitate the land acquisition necessary for the Gauge conversion of the Ratlam Indore Dr. Ambedkar Nagar Khandwa line, which has been identified as a Special Railway Project. This measure directly impacts landowners within the specified sub-divisions and districts in Madhya Pradesh, streamlining the process for the public purpose of executing, maintaining, managing, and operating the railway project.

Under the provisions of the Railways (Amendment) Act-2008, the Central Government exercised its powers to operationalize clause (7A) of section 2 of the said Act. This clause empowers the government to authorize designated officers to act as Competent Authorities for specific railway projects. The notification specifically named the Sub-Divisional Officer (Revenue) and Land Acquisition Officer for Malharganj in the Indore District as one such Competent Authority. The legislation provided: “In exercise of the powers conferred by clause (7A) of section 2 of the Railways (Amendment) Act-2008, the Central Government hereby authorised the officers nominated in column (2) of the Table below as Competent Authority to perform the function as such authority under the said act, with effect from the date of publication of this notification in the official Gazetted in respect of the Special Railway Project of Gauge conversion of Ratlam Indore Dr.Ambedkar Nagar Khandwa as a special Rail project for acquisition of land in the State of Madhya Pradesh relating to sub-Divisions mentioned in column (3) Districts mentioned in column (4) of the said table for the public purpose of execution, maintenance, management and operation of such Special Railway Project.”

The legislative intent behind this notification is to ensure the efficient and timely completion of vital public infrastructure projects. By formally designating Competent Authorities, the Central Government addresses potential statutory gaps or limitations that might arise in the absence of clear authorization for land acquisition. This action provides the necessary legal backing for the designated officers to perform their functions, thereby preventing delays in project execution.
