Central Government Designates Competent Authorities for Maharashtra Railway Projects

The Ministry of Railways (Central Railway) issued Notification S.O. 979(E) on February 21, 2025, which was subsequently published in the Official Gazette on February 25, 2025. This notification, a form of delegated legislation, served to authorize specific officers as Competent Authorities under The Railways Act, 1989. The primary reason for its issuance was to facilitate the execution, maintenance, management, and operation of a Special Railway Project involving the construction of Road Over Bridges (ROB) and Road Under Bridges (RUB) in lieu of seven existing Level Crossing Gates. This crucial infrastructure development is planned for the Nagpur-Itarsi and Nagpur-Ballarshah sections within the Nagpur Division of Maharashtra. The notification came into force upon its publication in the Official Gazette.
Under the provisions of this notification, the Central Government formally designated two key officers to assume the role of Competent Authority for the specified railway projects. These included the Deputy Collector (Land Acquisition) for the Wardha district, specifically for the Seloo Taluka, and the Sub-Divisional Officer and Land Acquisition Officer for the Nagpur district, covering the Saoner and Kohli areas. These officers are now empowered to perform the functions associated with a Competent Authority as outlined in The Railways Act, 1989, particularly clause (7A) of Section 2, which defines such an authority. Their authorization is critical for the smooth progression of the railway infrastructure initiatives in these regions.
The legislative intent behind this notification was to streamline and expedite the development of essential railway infrastructure. By formally designating Competent Authorities, the Central Government aimed to address potential administrative and legal hurdles that could arise during the execution of large-scale public works. The earlier statutory framework, The Railways Act, 1989, provided for the concept of a 'Competent Authority' but required specific designation for particular projects. This notification fills that gap, ensuring that the necessary legal and administrative powers are vested in appropriate officials for the timely completion of the Special Railway Project. The legislation provided: “...the Central Government hereby authorizes the Officers mentioned in column (2) of the Table below as the Competent Authority to perform the functions of such authority under the said Act with effect from the date of publication of this notification in the Official Gazette in respect of the Special Railway Project of Proposed construction of ROB RUB (7 Nos.) in lieu of Level Crossing Gates between Nagpur- Itarsi and Nagpur - Ballarshah section of Nagpur Division in the State of Maharashtra relating to District mentioned in column (4) of the said Table for the public purpose of execution, maintenance, management and operation of such Special Railway Projects.” This measure is expected to enhance public safety and improve the efficiency of railway operations by replacing level crossings, which are often points of congestion and accidents, with modern overpasses and underpasses.
