Central Government Designates Competent Authority for Land Acquisition for Andhra Pradesh Railway Project

The Ministry of Railways, through its South Central Railway division, issued a Notification, S.O. 1547(E), on March 24, 2025, formally designating a Competent Authority for land acquisition concerning a specific railway infrastructure project. This statutory instrument, published in the Gazette of India as an Extraordinary notification on April 1, 2025, came into force upon its publication. The notification was issued by the Central Government in exercise of the powers conferred by clause (7A) of Section 2 of the Railways Act, 1989, a central legislation governing the construction, maintenance, and operation of railways in India. The primary purpose of this notification was to streamline the process of land acquisition required for the execution, maintenance, management, and operation of a special railway project.

The specific project identified in the notification is the "Construction of Road Over Bridge in lieu of Level Crossing No. 384 at Km. 559/8-10 between Nidadavolu - Chigallu stations." This critical infrastructure development is situated in the state of Andhra Pradesh, specifically within the East Godavari district. For this particular undertaking, the Central Government authorized the Revenue Divisional Officer, Kovvur, to perform the functions of the Competent Authority for Land Acquisition. The legislation provided: “...the Central Government hereby authorizes the officer mentioned in the column (5) of the Table below to perform the functions of the Competent Authority for Land Acquisition in respect of the Special Railway Project as mentioned in column (2) of the Table for execution, maintenance, management and operation in the state mentioned in column (3) of the said table...” This designation ensures that a specific, empowered authority is responsible for managing the acquisition of land necessary for the project, thereby facilitating its timely implementation.

The legislative intent behind such notifications is to operationalize the provisions of the Railways Act, 1989, by providing a clear administrative framework for land acquisition, which is often a complex and time-consuming aspect of infrastructure development.
