The Ministry of Railways (South Central Railway) issued Notification S.O. 4162(E) on September 10, 2024, which came into force upon its publication in the Official Gazette on September 23, 2024. This instrument formally designated the construction of a specific Road Over Bridge as a "Special Railway Project." The Central Government exercised powers conferred by clause (37A) of Section 2 of the Railways Act, 1989, to issue this notification. The designation is pivotal for facilitating the acquisition of land required for the project, which involves building a Road Over Bridge in lieu of Level Crossing (LC) No. 469 at Kilometer 709/26-28. This infrastructure is planned between Narsipatnam Road and Regupalem Stations. The necessary land acquisition will occur in the Anakapalli District of Andhra Pradesh, serving the broader objective of providing national infrastructure for a public purpose.

The legislative intent behind this notification is to enable and expedite the development of crucial national infrastructure. By classifying the Road Over Bridge construction as a Special Railway Project, the Central Government utilizes a specific statutory mechanism within the Railways Act, 1989. This mechanism is designed to streamline processes, particularly land acquisition, for projects deemed essential for public utility. The earlier legal position, prior to such a specific designation, might have entailed a more prolonged land acquisition process. This notification addresses potential statutory gaps or limitations by invoking the special provisions of the Railways Act, thereby ensuring that vital infrastructure projects can proceed efficiently. The legislation provided: “...the Central Government hereby notifies Construction of Road Over Bridge... as a Special Railway Project for acquisition of land... for providing National Infrastructure for a public purpose...” This designation is a fundamental step in the development of the Road Over Bridge, which is a structure designed to carry a road over a railway line, thereby enhancing safety and improving traffic flow by eliminating existing level crossings. While the notification itself does not introduce new rights or obligations beyond its immediate scope, it triggers the application of existing legal frameworks for land acquisition under the Railways Act, 1989, specifically for this project. The policy rationale underscores the government's commitment to enhancing connectivity and safety across the national railway network.
