Central Government Designates Road Over Bridge Project in Andhra Pradesh as Special Railway Project

The Ministry of Railways, through its South Central Railway division, issued a notification on September 10, 2024, formally designating the construction of a Road Over Bridge (ROB) in Andhra Pradesh as a Special Railway Project. This notification, S.O. 4164(E), was published in the Official Gazette on September 23, 2024, and came into effect on that date. The instrument was issued in exercise of the powers conferred by clause (37A) of Section 2 of the Railways Act, 1989. The project involves the construction of a Road Over Bridge in lieu of Level Crossing No. 482, situated at Kilometer 740/6-8 between Bayyavaram and Anakapalle railway stations. This designation is specifically for the purpose of facilitating the acquisition of land required for the project in the Anakapalli District of Andhra Pradesh. The notification underscores the Central Government's commitment to providing national infrastructure for a public purpose.
The legislative intent behind this notification is to streamline the process of land acquisition for critical railway infrastructure projects. By designating the Road Over Bridge construction as a "Special Railway Project" under the Railways Act, 1989, the Central Government leverages specific provisions within the Act designed to expedite such developments. The earlier legal position, prior to such designations, might have involved more protracted land acquisition procedures under general laws, potentially delaying essential infrastructure development. This notification addresses potential statutory gaps or limitations in general land acquisition frameworks by utilizing the specialized provisions of the Railways Act. The construction of a Road Over Bridge, replacing an existing level crossing, aims to enhance safety for both road and rail users by eliminating direct intersections, thereby reducing accidents and improving traffic flow. It also contributes to the efficiency of railway operations by removing the need for trains to slow down or stop for road traffic at level crossings. The legislation provided: “…Construction of Road Over Bridge in lieu of Level Crossing No. 482 at Km. 740/6-8 between Bayyavaram - Anakapalle stations as a Special Railway Project for acquisition of land in the State of Andhra Pradesh in the District of Anakapalli for providing National Infrastructure for a public purpose…” This action enables the Central Government to proceed with the necessary land acquisition for this vital public infrastructure project, ensuring its timely implementation and contributing to the overall development of national transportation networks.
