Central Government Finalizes Land Acquisition for Wadsa-Gadchiroli New Rail Line Project

The Ministry of Railways (South East Central Railway) issued a significant notification, S.O. 3846(E), on August 22, 2025, formally declaring the acquisition of land for the Wadsa Gadchiroli New Rail line (49.50 KM) Project. This notice, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), operates under Section 20E of the Railways Act, 1989 (24 of 1989). The declaration pertains to land situated in the Gadchiroli District of Maharashtra and came into force upon its publication in the Official Gazette on the same date.

This final acquisition notice followed a structured legal process initiated by the Central Government. An earlier notification, S.O. 2179 (A), dated May 16, 2025, had declared the government's intention to acquire land for the aforementioned Special Railway Project, as mandated by sub-section (1) of Section 20A of the Railways Act, 1989. The substance of this initial declaration was subsequently published in local newspapers, namely Gadchiroli Patrika and Chaundeshwari Darshan (Gadchiroli Edition), on May 23, 2025, fulfilling the requirement under sub-section (4) of Section 20A of the Act to inform the public.

During the intervening period, objections to the proposed acquisition were received from affected parties. These objections were duly heard by the Competent Authority, which then passed orders in accordance with Section 20D of the Railways Act. Following this process, the Competent Authority submitted its comprehensive report to the Central Government, as stipulated by sub-section (1) of Section 20E of the Act.

Upon receipt of this report and in exercise of the powers conferred by sub-section (1) of Section 20E, the Central Government proceeded to declare the acquisition of the specified land. A crucial legal consequence of this declaration, as outlined in the legislation, is that the land vests absolutely in the Central Government. The legislation provided: “...on publication of the notification in the Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.” This provision ensures a clear title for the acquired land, facilitating the smooth progress of the railway project.

The Schedule annexed to the notification provides a detailed description of the land parcels to be acquired, including survey numbers, account holders, and the total area in hectares. The acquisition targets land in various villages within the Desaiganj Taluka of Gadchiroli District, Maharashtra, amounting to a total of 11.09 hectares. This detailed listing ensures transparency and precision in the acquisition process, identifying all affected properties for the Wadsa-Gadchiroli new Broad Gauge line.

The primary objective behind this land acquisition is to enable the "execution, maintenance, management and operation" of the Special Railway Project. This action aligns with the broader policy rationale of enhancing national infrastructure and connectivity, particularly in regions like Gadchiroli. The Railways Act, 1989, provides the statutory framework for such acquisitions, balancing the public interest in developing essential infrastructure with the rights of landowners through a defined process for objections and compensation.
