Central Government Notifies Additional Hotgi Bye Pass Line as Special Railway Project for Land Acquisition

The Ministry of Railways, acting through the Central Railway administration, issued a formal notification designating the Additional Hotgi Bye Pass line as a Special Railway Project. This statutory instrument, identified as S.O. 2441(E), was promulgated under the specific powers granted by the Railways Act, 1989, as amended by the Railway (Amendment) Act, 2008. The notification officially classified the 5.85-kilometer stretch located within the Solapur District of Maharashtra as a critical infrastructure undertaking. This legal designation became effective immediately upon its publication in the Official Gazette on May 30, 2025, following its initial issuance by the Chief Administrative Officer (Construction) in Mumbai on May 23, 2025.

The primary objective of this notification was to streamline the process for the acquisition of land required for the bypass line. By categorizing the 5.85-kilometer project as a Special Railway Project (a statutory classification reserved for projects of national importance or public utility), the Central Government invoked specialized legal provisions intended to accelerate infrastructure development. The legislation provided: “In exercise of the powers conferred by clause (37A) of Section 2 of The Railways Act, 1989 (24 of 1989) the Central Government hereby notifies Additional Hotgi Bye Pass line (5.85 Km) of Central Railway as Railway project under Central Railway, under Special Railway Project for acquisition of land in Solapur District of Maharashtra State, for providing national infrastructure for a public purpose with effect from the date of publication of this notification in the Official Gazette.”

Under the existing statutory framework of the Railways Act, 1989, the declaration of a "Special Railway Project" (a project notified by the Central Government for providing national infrastructure) allows for a distinct land acquisition procedure. This notification substituted the general acquisition requirements with the expedited mechanisms available for special projects, thereby addressing potential statutory gaps or delays in regional infrastructure growth. The enforcement of this notification ensures that the Central Railway has the legal authority to proceed with the necessary land transfers in Solapur to meet the project's technical and operational timelines.
