The Central Government has officially triggered the enforcement of three specific sections of the Finance Act, 2026, establishing a clear timeline for the next phase of India’s fiscal legislative rollout. By exercising its delegated powers, the Ministry of Finance has appointed November 1, 2026, as the date these statutory changes become active law.

Background

The Notification No. 03/2026-Central Tax was issued by the Ministry of Finance (Department of Revenue) to operationalize specific portions of the Finance Act, 2026. Under clause (b) of sub-section (2) of section 1 of the parent Act, the government is authorized to appoint different dates for the commencement of various provisions. This latest notification, published under S.O. 5791(E), follows the legislative scheme of the Finance Act, 2026 which received the number 4 of 2026. The notification acts as the formal mechanism to transition dormant legislative provisions into active regulatory requirements.

Stakeholders Impacted

The activation of these provisions primarily affects taxpayers and corporate entities whose operations fall under the jurisdictional scope of the Finance Act, 2026. Specifically, the enforcement of Sections 153, 154, and 155 will impact tax compliance officers, legal practitioners, and businesses engaged in activities regulated by the Central Tax framework. Furthermore, the Ministry of Finance and the Central Board of Indirect Taxes and Customs (CBIC) are directly impacted as the primary enforcement authorities for these sections.

Key Provisions

Activation of Dormant Clauses:

The notification explicitly mandates the commencement of Sections 153, 154, and 155 of the Finance Act, 2026. While the notification itself does not describe the specific substantive changes within these sections, it serves as the mandatory legal trigger for their application.

Exercise of Appointment Powers:

In accordance with the legislative design of the Finance Act, 2026, the Central Government has utilized Section 1(2)(b) to staggered the implementation of the Act. This specific move focuses solely on the three aforementioned sections, leaving other provisions to be governed by their respective commencement schedules as determined by the Ministry.

Practical/Compliance Impact

Affected stakeholders must ensure that all systems, filings, and compliance protocols related to Sections 153, 154, and 155 are fully updated and operational before the start of November. Since the Notification No. 03/2026-Central Tax does not provide for a transition period beyond the appointed date, non-compliance from November 1, 2026, onwards may attract the standard penalties and consequences prescribed under the Finance Act, 2026. Businesses are advised to review the specific legal requirements of these activated sections to avoid administrative friction with the tax authorities.

Effective Date

The provisions of sections 153 to 155 of the Finance Act, 2026 shall officially come into force on the 1st day of November, 2026. The Notification No. 03/2026-Central Tax was signed by the Under Secretary on the 26th of October, 2026, and published in the Extraordinary Gazette on the same day.
