Central Government Notifies Final Land Acquisition for Dahod-Indore Railway Project in Madhya Pradesh

The Ministry of Railways (Western Railway Construction Organization) issued Notification S.O. 915(E) on February 20, 2025, formally declaring the acquisition of land for the new Broad Gauge (BG) line project connecting Dahod to Indore. This notification, published in the Gazette of India, Extraordinary, Part II, section 3 Sub-section (ii), finalizes the acquisition process for specific land parcels in Ranipura village, located in the Dhar Tehsil and District of Madhya Pradesh. The Central Government had previously declared its intention to acquire this land through Notification S.O. 262(E) dated January 15, 2025, which was issued under sub-section (1) of section 20A of the Railway (Amendment) Act, 2008 (11 of 2008). The purpose of this acquisition is to facilitate the execution, maintenance, management, and operation of this Special Railway Project, which will traverse through Jhabua, Sardarpur, Dhar, and Pithampur. The substance of the initial intention notification was subsequently published in daily newspapers, including Dainik Bhaskar, Patrika, and Times Nation, on January 21, 2025, in compliance with sub-section (4) of section 20A of the said Act. Following this, objections were received from residents of Ranipura village, which were duly considered and resolved by the competent authority. Upon the submission of the competent authority's report to the Central Government, as mandated by sub-section 20E of the Railway (Amendment) Act, 2008, this final notification was issued. The legislation provided: “...the Central Government hereby declares that on publication of this notification in the official Gazette, the land specified in the schedule annexed hereto shall vest absolutely in the Central government free from all encumbrances.” This means that upon its publication on February 20, 2025, the specified land, totaling 1.1867 hectares across various Khasara numbers, became the absolute property of the Central Government, free from any prior claims or liabilities.
The legislative intent behind this notification is to advance critical railway infrastructure development, specifically the construction of the new Dahod-Indore BG line. This project aims to enhance connectivity and facilitate transportation in the region, serving as a vital link through several districts in Madhya Pradesh. The earlier legal position was governed by the Railway (Amendment) Act, 2008, which outlines a structured process for land acquisition for railway projects, beginning with an intention declaration, public notification, and a mechanism for addressing objections. This notification addresses the statutory gap between the declaration of intent and the actual vesting of land, ensuring a clear legal title for the Central Government to proceed with the project. It amends the legal status of the specified land parcels by converting private holdings into government property for public utility. The process ensures that objections from affected landholders are heard and resolved before the final acquisition. The enforcement mechanism is immediate and absolute, with the land vesting in the Central Government upon the notification's publication, thereby enabling the prompt commencement of construction activities for the railway line.
