Central Government Notifies Key Provisions of Code on Social Security, 2020

The Ministry of Labour and Employment issued a significant Notification, S.O. 5319(E), on November 21, 2025, bringing into force a substantial portion of the Code on Social Security, 2020. This delegated legislation, published in the Gazette of India, marks a crucial step towards the operationalization of the comprehensive social security framework envisioned by the Parliament. The Notification, issued under the authority granted by sub-section (3) of section 1 of the Code on Social Security, 2020 (Act 36 of 2020), specifies that various key provisions of the Code would become effective from the date of its publication. Specifically, sections 1 to 14, sub-sections (1) and (2) of section 15, clause (c) of sub-section (1) of section 16, sections 17 to 141, sections 144 to 163, and certain items and clauses of section 164 were brought into force. Additionally, section 143 was also made effective, with the exception of provisions previously specified in S.O. 2060 (E) dated May 3, 2023. This action by the Central Government ensures that a wide array of social security measures and administrative mechanisms outlined in the Code are now legally enforceable, impacting millions of workers, employers, and the overall social welfare landscape across the country. The legislation provided: “...the Central Government hereby appoints the 21st day of November, 2025 as the date on which the following provisions of the said Code, shall come into force...”

The primary aim of this Notification is to implement the legislative intent behind the Code on Social Security, 2020, which was enacted to consolidate and amend the laws relating to social security with the objective of extending social security benefits to all employees and workers. Prior to the Code, India's social security framework was characterized by a multitude of fragmented laws, leading to complexities in administration, limited coverage, and varying benefits across different sectors and types of employment. The Code was designed to address these statutory gaps and limitations by creating a unified and more inclusive system. It seeks to provide universal social security coverage, including provisions for provident fund, employee state insurance, gratuity, maternity benefit, and other welfare schemes, to both organized and unorganized sector workers. By bringing these specific sections into force, the government is enabling the establishment of new authorities, the formulation of rules, and the implementation of mechanisms necessary for the delivery of these benefits. This move is expected to streamline the administration of social security, enhance portability of benefits for migrant workers, and ensure greater transparency and accountability in the system, thereby fulfilling the Code's overarching policy rationale of ensuring a dignified life and social protection for the workforce.
