Central Government Notifies Land Acquisition for Ankai Bypass Line Project in Nashik

The Ministry of Railways (South Central Railway) issued Notification S.O. 1063(E) on February 27, 2025, which was subsequently published in the Gazette of India, Extraordinary, Part II, section 3 Sub-section (ii), on February 28, 2025. This notification formally declared the acquisition of specific land parcels for the Ankai Bypass Line project, a Special Railway Project located in the Nashik District of Maharashtra. The issuance of this notification followed an earlier declaration of intent by the Central Government, made through Notification S.O. 1619 (E) dated April 04, 2024, under sub-section (1) of section 20A of the Railway Act, 1989 (24 of 1989). That initial notification had specified the land intended for acquisition for the execution, maintenance, management, and operation of the railway project. The substance of the earlier notification was also published in the daily newspaper Navbharat Lokmat Times on August 30, 2024, in compliance with sub-section (4) of section 20A of the said Act. Following this public notice, no objections were received from the affected Ankute Kusur villages, leading to the Competent Authority passing necessary orders. Subsequently, the Competent Authority submitted its report to the Central Government in pursuance of sub-section (1) of section 20E of the Railway Act, 1989. Upon receipt of this report, the Central Government exercised its powers under sub-section (1) of section 20E of the Act to declare the acquisition of the lands detailed in the annexed schedule. The legislation provided: “...the Central Government hereby declares that on publication of this notification in the official Gazette, the land specified in the schedule annexed hereto shall vest absolutely in the Central government free from all encumbrances.” This means that upon the notification's publication, the Central Government assumes full and unencumbered ownership of the specified land, free from any prior claims or liabilities. The schedule appended to the notification meticulously lists the land acquisition cases, village names (Ankute and Kusur in Yeola Taluka), survey numbers, landholder names, total area, and the specific area to be acquired, including details of existing assets such as wells, constructions, and trees.
