Central Government Notifies Land Acquisition for Kanpur Ring Road Project

The Ministry of Road Transport and Highways issued Notification S.O. 3693(E) on August 13, 2025, formally declaring the acquisition of land for the development of a Ring Road in Kanpur Nagar, Uttar Pradesh. This delegated legislation, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), finalizes the process initiated by an earlier notification dated January 23, 2025. That prior notification, issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956), had expressed the Central Government's intention to acquire land for the building, maintenance, management, and operation of the Ring Road, specifically for widening or four-laning, along a stretch from Km. 59.075 to Km. 67.5. The substance of the initial declaration of intent was subsequently published in local newspapers, "Aaj" and "The Indian Express," both on January 29, 2025, as required by sub-section (3) of section 3A of the said Act. Following this, the Competent Authority, located in Kanpur Nagar, received and appropriately settled objections filed under Section 3-C of the Act. The Competent Authority then submitted its report to the Central Government in pursuance of sub-section (1) of section 3D of the Act. Upon receipt of this report, the Central Government proceeded with the current notification, which declares that the specified land should be acquired for the stated purpose. The notification further stipulates that upon its publication in the Official Gazette, the land detailed in the annexed Schedule shall vest absolutely in the Central Government, free from all encumbrances (claims or liabilities on the land). The Schedule provides a brief description of the land, including survey/plot numbers, type of land (e.g., Government Agriculture, Private Agriculture, Jangal, Ganga Nadi, Reta), area in hectares, and names of land owners or interested persons, across villages like Mawaiya and Katri Jana within the Kanpur Nagar district.

The legislative intent behind this notification is to advance critical infrastructure development by facilitating the construction and operationalization of the Ring Road in Kanpur Nagar. This project aims to enhance connectivity and ease traffic congestion within the region by providing a widened or four-laned highway. The earlier legal position involved a preliminary declaration of intent to acquire land, which is a standard procedure under the National Highway Act, 1956, allowing for public input and objections. The statutory framework ensures that due process is followed, including the consideration and settlement of objections by a Competent Authority, before the final acquisition is declared. This notification addresses the procedural requirements and statutory gaps by moving from the declaration of intent to the actual vesting of land, thereby enabling the project to proceed. The legislation provided: “...the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.” This vesting signifies the transfer of full ownership and control to the Central Government, unburdened by any prior claims or rights. The enforcement mechanism is the notification itself, which, upon publication, legally transfers ownership, allowing for the commencement of construction activities for the Ring Road project. This action does not introduce new rights or obligations beyond those already established under the National Highway Act, 1956, but rather executes the powers conferred by it for public infrastructure development.
