Central Government Notifies Land Acquisition for NH146 Widening in Madhya Pradesh

The Ministry of Road Transport and Highways issued a notification, S.O. 3945(E), on August 28, 2025, formally declaring the acquisition of land for the development of National Highway 146 (NH146) in Madhya Pradesh. This notification, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), follows an earlier declaration of intention made by the Central Government on June 30, 2025, under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956). The land, spanning from Km. 48.718 to Km. 59.476 within the Vidisha district, is designated for building, including widening, two-laning with paved shoulders, or four-laning, as well as for the maintenance, management, and operation of NH146. The substance of the initial notification was subsequently published in local newspapers, Nav Duniya and Free Press, on July 5, 2025, in compliance with sub-section (3) of section 3A of the said Act. Following this, the Competent Authority received and appropriately settled objections filed under Section 3-C of the Act. The Competent Authority then submitted its report to the Central Government in pursuance of sub-section (1) of section 3D of the Act. Upon receipt of this report, the Central Government exercised its powers under sub-section (1) of section 3D to declare the necessity of acquiring the specified land. The notification further stipulated that, upon its publication in the Official Gazette, the land detailed in the annexed Schedule shall vest absolutely in the Central Government, free from all encumbrances (claims or liabilities on the property), as per sub-section (2) of section 3D of the Act. The Schedule provides a brief description of the land to be acquired, including survey/plot numbers, type of land (e.g., private irrigated, government charagah, private residential, private commercial), area in hectares, and names of land owners or interested persons across villages such as Mirzapur, Tilakhedi, and Vidisha within the Vidisha Taluk. The total area of land acquired through this notification is 0.898 hectares.

The legislation provided: “And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.” This provision ensures that once the acquisition process is complete, the government has unhindered ownership and control over the land for the designated highway project.
