Central Government Notifies Rules for Recruitment and Service Conditions of Central Consumer Protection Authority Employees

The Central Government, through the Ministry of Consumer Affairs, Food and Public Distribution (Department of Consumer Affairs), issued a notification on June 3, 2024, establishing the Central Consumer Protection Authority (Recruitment, Salary, Allowances and other Terms and Conditions of Service of Officers and Other Employees of Central Authority) Rules, 2024. These rules, designated as G.S.R. 306(E), were promulgated in exercise of powers conferred by sub-section (1) and clause (h) of sub-section (2) of section 101, read with sub-sections (1) and (2) of section 13 of the Consumer Protection Act, 2019 (35 of 2019). The new rules came into force on June 4, 2024, the date of their publication in the Official Gazette. They define key terms such as "Act" (referring to the Consumer Protection Act, 2019), "employee" (encompassing the Secretary, officers, and other employees of the Central Authority), and "Schedule" (the annexure detailing specific provisions).
The rules primarily govern the recruitment and appointment processes for various positions within the Central Consumer Protection Authority (CCPA), a statutory body established under the Consumer Protection Act, 2019, to protect and enforce consumer rights. They stipulate that the number of sanctioned posts, mode of recruitment, and eligibility criteria for each level or grade shall be as specified in the annexed Schedule. Appointments across all levels are to be made by the Central Government based on recommendations from a designated Selection Committee. The CCPA is tasked with inviting applications, assessing suitability, and forwarding a list of eligible candidates to the Selection Committee for the final selection process. The remuneration for employees is determined by the pay matrix levels outlined in the Schedule, with provisions for employees appointed on deputation to elect between the pay scale of the ex-cadre post or their parent cadre pay with deputation allowance. Furthermore, the rules address official visits abroad by employees, requiring prior approval from the Chief Commissioner or Commissioner of the Central Authority and adherence to instructions from the Ministries of External Affairs and Finance. A residuary provision mandates that any service-related matters not explicitly covered by these rules shall be referred to the Central Government for a final and binding decision. The Central Government also retains the power to relax any provisions of these rules for specific classes or categories of persons, provided reasons are recorded in writing. The legislation provided: “The number of posts sanctioned at each level or grade, mode of recruitment, and eligibility for each level or grade shall be as specified in the Schedule.”
The legislative intent behind these rules is to establish a comprehensive and transparent framework for the human resource management of the Central Consumer Protection Authority. Prior to these rules, the operationalization of the CCPA's staffing structure lacked a detailed statutory framework, which these rules now address. By specifying the number of posts, classifications (Group 'A', 'B', 'C'), pay matrix levels, educational qualifications, experience requirements, and the method of recruitment—primarily through deputation (including short-term contract)—the rules aim to ensure that the CCPA is staffed with qualified and experienced personnel. The inclusion of detailed Selection Committee compositions for each post, typically involving the Chief Commissioner, Commissioner, and Director General (Investigation) of the CCPA, underscores a commitment to merit-based appointments. The rules also set clear timelines for deputation periods, ordinarily not exceeding three years but extendable up to a maximum of five years, and a maximum age-limit of fifty-six years for appointment by deputation. This structured approach is designed to enhance the efficiency and effectiveness of the CCPA in fulfilling its mandate under the Consumer Protection Act, 2019, thereby strengthening consumer protection mechanisms across the country.
