Central Government Notifies Service Rules for National Consumer Commission Employees

The Central Government recently issued The Consumer Protection (National Commission and State Commissions) (Recruitment, Salary, Allowances and Conditions of Service) Rules, 2023, a significant piece of delegated legislation aimed at streamlining the administrative framework for consumer redressal bodies. These rules, published in the Official Gazette on May 4, 2023, came into force immediately upon their publication. The new regulations establish comprehensive guidelines for the appointment, remuneration, and overall service conditions of officers and employees within the National Commission, operating under the overarching Consumer Protection Act, 2019.

The rules define key terms such as "Act" (referring to the Consumer Protection Act, 2019), "Appellate Authority," "Appointing Authority," "direct recruitment," and "Disciplinary Authority," providing clarity on the administrative hierarchy and processes. Chapter II of the rules details the procedures for appointment to various posts, stipulating that all appointments must adhere to recruitment rules notified by the Central Government. It further specifies that the pay and allowances for employees will generally be regulated in line with those applicable to Central Government servants holding corresponding posts in the General Central Services, with provisions for deputation terms to be mutually determined by borrowing and lending organizations, subject to the President of the National Commission's approval. The classification of posts within the National Commission is also outlined, categorizing them into Group A, B, and C based on their pay matrix levels.

Chapter III of the rules addresses classification, conduct, discipline, and appeal mechanisms. It mandates that employees of the National Commission shall be subject to Central Government rules and instructions concerning conduct, discipline, and appeal. The rules explicitly delineate the Appointing, Disciplinary, Appellate, and Reviewing Authorities for different categories of posts, including the Registrar and other Group A, B, and C positions. A crucial safeguard is enshrined, stating that no employee shall be removed or dismissed from service by an authority lower than the appointing authority. Furthermore, the rules emphasize the scope of service, requiring employees to dedicate their full time to the National Commission and serve with absolute integrity. The legislation provided: “Every employee shall serve the National Commission with absolute integrity and show utmost courtesy and attention in all transactions and dealings with the public, and between the officers of the Central Government and the National Commission.” Employees are also bound to maintain secrecy regarding confidential information and are prohibited from using official knowledge for personal gain or for the benefit of friends or relatives.

The legislative intent behind these rules is to ensure the efficient and transparent functioning of the National Commission by establishing a clear, standardized, and robust framework for its human resources. By aligning the service conditions with those of Central Government employees, the rules aim to attract and retain qualified personnel, thereby strengthening the institutional capacity of the consumer redressal mechanism established under the Consumer Protection Act, 2019. These regulations address the statutory gap concerning detailed service conditions for the staff of the National Commission, which is vital for the effective implementation of consumer protection laws. The rules also include provisions for training, allowing for disciplinary action against employees for misconduct during training periods, and grant the President of the National Commission the power to relax certain rules in cases of undue hardship, subject to Central Government approval. A saving clause ensures that existing reservations and concessions for Scheduled Castes, Scheduled Tribes, Ex-servicemen, and other special categories remain unaffected. Any questions regarding the interpretation of these rules will be referred to the Central Government, whose decision will be final and binding.
