The Ministry of Railways (South Central Railway) issued a Notification, S.O. 933(E), on February 21, 2025, which came into force upon its publication in the Official Gazette on the same date. This instrument was issued in exercise of the powers conferred by clause (37A) of Section 2 of the Railways Act, 1989. The primary reason for its issuance was to formally designate a specific infrastructure development as a "Special Railway Project," thereby enabling the acquisition of land required for its construction. The notification specifically identified a Road Over Bridge (ROB) to be constructed in lieu of Level Crossing (LC) No. 228. This project is situated between Wadiaram and Masaipet Stations within the Secunderabad-Mudkhed section of the Hyderabad Division, falling under the jurisdiction of the South Central Railway. The key legal consequence of this notification is to facilitate the land acquisition process in the Medak District of Telangana, which is essential for the execution of this national infrastructure project. The notification explicitly stated that the project serves a public purpose.

The legislative intent behind this notification is to advance critical national infrastructure development by leveraging existing provisions within the Railways Act, 1989. The policy rationale underscores the government's commitment to enhancing railway safety and efficiency, particularly by replacing at-grade level crossings with overpasses. The earlier legal position, as reflected in the Railways Act, 1989, provides for the classification of certain projects as "Special Railway Projects" under clause (37A) of Section 2. This classification is crucial as it streamlines the procedures for land acquisition, which can often be a significant hurdle in large-scale infrastructure projects. By designating the Road Over Bridge project as a "Special Railway Project," the notification addresses potential statutory gaps or limitations that might otherwise impede the swift and effective acquisition of necessary land. The legislation provided: “the Central Government hereby notifies Road Over Bridge in lieu of LC No. 228 between Wadiaram and Masaipet Stations in Secunderabad - Mudkhed section of Hyderabad Division over South Central Railway as a Special Railway Project for acquisition of land in the State of Telangana in the District of Medak for providing National Infrastructure for a public purpose”. This designation introduces the obligation for the relevant authorities to proceed with land acquisition in the specified district, ensuring that the project can move forward. While the notification itself does not amend existing laws, it operationalizes a specific provision of the Railways Act, 1989, to enable the creation of new infrastructure. The construction of a Road Over Bridge (an overpass for road traffic above railway lines) is a common measure to eliminate Level Crossings (a point where a railway line crosses a road at the same level), thereby reducing accidents and improving the flow of both road and rail traffic. The enforcement mechanism for this project's land acquisition is now firmly established through this official notification, setting the stage for the subsequent administrative and legal steps required for project implementation.
