Consumer Protection Rules Amended to Bar Post-Retirement Practice by Commission Members

The Central Government recently issued the Consumer Protection (Salary, allowances and conditions of service of President and Members of the State Commission and District Commission) (Amendment) Model Rules, 2024. These rules, published as a Notification bearing G.S.R. 474(E) by the Ministry of Consumer Affairs, Food and Public Distribution (Department of Consumer Affairs) on August 2, 2024, came into force immediately upon their publication in the Official Gazette. The amendment was enacted in exercise of the powers conferred under the proviso to sub-section (1) of section 102 of the Consumer Protection Act, 2019 (35 of 2019). The primary effect of these new rules is to modify the existing Consumer Protection (Salary, allowances and conditions of service of President and Members of the State Commission and District Commission) Model Rules, 2020, specifically concerning the professional conduct of retired members. The amendment directly impacts the Presidents and Members of State Commissions and District Commissions, introducing a clear prohibition on their post-retirement legal practice before these bodies.

The legislative intent behind this amendment is to uphold the integrity and impartiality of the consumer dispute resolution mechanism. By preventing former Presidents and Members from practicing before the very commissions they once served, the government aims to eliminate any potential for conflict of interest or the perception of undue influence. This measure reinforces public trust in the fairness and objectivity of the consumer justice system. The amendment addresses a crucial aspect of ethical conduct for judicial and quasi-judicial bodies, ensuring that individuals who have held positions of authority do not subsequently leverage their past roles for personal gain in legal proceedings. The earlier legal framework, specifically the Consumer Protection (Salary, allowances and conditions of service of President and Members of the State Commission and District Commission) Model Rules, 2020, has been updated to incorporate this explicit restriction. The legislation provided: “The President or Member shall not practice before the State Commission or the District Commission, after retirement from the service of that Commission.” This substitution in rule 11, for sub-rule (2), clarifies the statutory position and introduces a new obligation for retired personnel, thereby strengthening the ethical guidelines governing these important consumer protection bodies. The amendment ensures that the statutory framework is robust in preventing situations that could compromise the independence and credibility of the State and District Consumer Commissions.
