Draft Rules Propose Revised Definition for Competent Authority in Lawful Telecommunication Interception

The Ministry of Communications, Department of Telecommunications, published draft rules on June 27, 2025, proposing amendments to the Telecommunications (Procedures and Safeguards for Lawful Interception of Messages) Rules, 2024. These draft rules, titled the Telecommunications (Procedures and Safeguards for Lawful Interception of Messages) Amendment Rules, 2025, were issued under the powers conferred by the Telecommunications Act, 2023 (44 of 2023). The Central Government has made these draft rules available for public information, inviting objections or suggestions from all persons likely to be affected, with a thirty-day period for submission from the date of their publication in the Official Gazette. Upon finalization, these rules are slated to come into force on the date of their publication in the Official Gazette.

The primary change introduced by the draft rules concerns the definition of "competent authority" under item (c) of rule 2 of the principal 2024 Rules. The proposed amendment substitutes the existing definition with a more detailed framework for designating the authority responsible for authorizing lawful interception of telecommunication messages. Under the revised definition, the Union Home Secretary in the Ministry of Home Affairs is designated as the competent authority for the Central Government. For State Governments, the Secretary to the State Government in charge of the Home Department holds this authority. A significant addition addresses situations where interception extends beyond a State Government's territorial jurisdiction; in such cases, the Union Home Secretary in the Ministry of Home Affairs of the Central Government becomes the competent authority, acting upon a request made by the Secretary in-charge of the Home Department of the concerned State Government.

The legislation provided: “(c) “competent authority” means, as the case may be, (i) the Union Home Secretary in the Ministry of Home Affairs in the case of the Central Government, or (ii) the Secretary to the State Government in charge of the Home Department in the case of a State Government, or (iii) the Union Home Secretary in the Ministry of Home Affairs of the Central Government, on the request made by the Secretary in-charge of the Home Department of the State Government for interception by that State Government beyond its territorial jurisdiction.”

This amendment aims to clarify and streamline the process for authorizing lawful interception of telecommunication messages, particularly addressing scenarios that involve multiple jurisdictions. The legislative intent is to ensure that a clear and unambiguous authority is designated for such sensitive operations, thereby enhancing procedural safeguards and accountability. The earlier legal position, as defined in the 2024 rules, is being updated to address potential statutory gaps or ambiguities concerning interception requests that cross state boundaries. By explicitly designating the Union Home Secretary for inter-state interception requests originating from State Governments, the amendment seeks to provide a robust mechanism for coordination and authorization, ensuring that lawful interception activities are conducted with proper oversight and adherence to legal protocols. The public consultation period allows stakeholders to provide input on these proposed changes, which are intended to refine the operational framework for telecommunication interception under the Telecommunications Act, 2023.
