Entitlement to Annual Increment Crystallizes Upon Completion of Service: Madhya Pradesh HC

Copy LinkShareSave

Government servants completing a full year of service on their last day of employment cannot be denied annual increments simply because they retire a day before the increment officially falls due. The Madhya Pradesh High Court has reinforced the principle that increments are earned through past service and good conduct, not merely by being present in office on the date of payment.

Justice Pavan Kumar Dwivedi presided over the matter, considering whether a petitioner who superannuated on December 31, 2025, was legally entitled to the annual increment due on January 1, 2026. The Court navigated the evolving jurisprudence surrounding retiral benefits and the specific administrative circulars issued by the State government to streamline these payments.

Key Takeaways

Crystallization of Rights

Increment entitlement is not a prospective gift but a right that crystallizes once an employee completes the requisite length of service with good conduct.

Retroactive Pensionary Adjustments

While increments must be added to the pension calculation, the actual payment of arrears is subject to specific timelines to prevent indefinite financial liability for the State.

Impact of Administrative Circulars

State directives, such as the Madhya Pradesh Circular dated 15.03.2024, now explicitly recognize the rights of employees retiring on June 30 or December 31.

Judicial Clarification on Increment Entitlement

The Court emphasized that the right to an increment is earned for service rendered in the preceding year. Relying on the precedent set in Director (ADMN) & HR KPTCL vs. C.P. Mundinamani, the Bench noted that the entitlement to receive an increment crystallizes when the Government servant completes the required service length and becomes payable on the succeeding day.

Following the Apex Court's decision in Union of India & Another vs. M. Siddaraj, the High Court clarified the timelines for arrears. The Court has the following directions:

"(a) The judgment dated 11.04.2023 will be given effect to in case of third parties from the date of the judgment, that is, the pension by taking into account one increment will be payable on and after 01.05.2023. Enhanced pension for the period prior to 31.04.2023 will not be paid.

(b) For persons who have filed writ petitions and succeeded, the directions given in the said judgment will operate as res judicata, and accordingly, an enhanced pension by taking one increment would have to be paid.

(c) The direction in (b) will not apply, where the judgment has not attained finality, and cases where an appeal has been preferred, or if filed, is entertained by the appellate court.

(d) In case any retired employee filed an application for intervention /impleadment / writ petition / original application before the Central Administrative Tribunal / High Courts / this Court, the enhanced pension by including one increment will be payable for the period of three years prior to the month in which the application for intervention / impleadment / writ petition/ original application was filed."

The Court, in its reasoning, observed: "The Apex Court held that the entitlement to receive increment crystallizes when the Government servant completes a requisite length of service with good conduct and becomes payable on the succeeding day. The Apex Court further held that annual increment earned on the last day of service for rendering good service preceding one year from the date of retirement with good behaviour and efficiency is liable to be paid to the employee."

Ratio

An employee who retires on the last working day of a service year after completing one full year of service with good conduct is legally entitled to the annual increment falling due on the subsequent day, as the benefit is a reward for the service already rendered and not a condition of future employment.

Background

The petitioner, Madanlal Malviya, retired from service on December 31, 2025. He approached the High Court seeking the benefit of the annual increment due on January 1, 2026, which would subsequently increase his retiral benefits and pension. The State argued that while they were implementing circulars to grant such benefits, delays in approaching the Court should restrict the petitioner's claims to interest and long-term arrears.

The Court referred to Rushibhai Jagdishbhai Pathak vs. Bhavnagar Municipal Corporation ( "AIR Online 2022 SC 735": 2022 CaseBase(SC) 25) to determine the limitation on arrears, restricting them to three years prior to the filing of the writ petition. The Court disposed of the petition with a direction to the respondents to grant the increment due on January 1, 2026, recalculate the retiral benefits, and pay the revised pension and arrears within three months.
