Goa Government Notifies New Boilers Penalty Adjudication and Appeal Rules, Introduces Agricultural Subsidies and Staffing Changes

The Government of Goa recently published a series of legislative instruments in the Official Gazette, Series I No. 33, dated 13th November, 2025, including the formal notification of the Goa Boilers (Penalty Adjudication and Appeal) Rules, 2025. These rules, issued by the Inspectorate of Factories & Boilers, constitute delegated legislation made under the powers conferred by Sections 35, 36, and 42 of the Boilers Act, 2025 (Central Act No. 12 of 2025). The pre-publication process for these rules, as mandated by sub-section (1) of Section 42 of the parent Act, involved inviting objections and suggestions, with no such feedback received within the stipulated period. The new rules came into force upon their publication in the Official Gazette.

The Goa Boilers (Penalty Adjudication and Appeal) Rules, 2025, establish a comprehensive framework for addressing contraventions of the Boilers Act, 2025. They define key terms such as "Adjudicating Officer" and "Appellate Authority" and outline the detailed procedure for adjudication proceedings. Upon receiving a report from an Inspector, the Chief Inspector is tasked with examining the case to determine if a contravention punishable under Sections 27, 28, sub-section (1) of Section 30, or Section 31 of the Act has occurred. If so, the Inspector is authorized to file an application for adjudication with the Adjudicating Officer, who then commences an inquiry. This inquiry involves issuing a notice to the owner, providing an opportunity for hearing within thirty days, explaining the alleged offence, and allowing the presentation of evidence. The Adjudicating Officer is mandated to pass a final order within 180 days from the first hearing, imposing penalties where contraventions are proven or dismissing the case if not. The rules also specify the manner of preferring an appeal under Section 36 of the Act, requiring appeals to be filed with the Appellate Authority in a prescribed format (Form 'A') within sixty days, accompanied by a fee of one thousand rupees. The Appellate Authority, after hearing the parties, may confirm or set aside the order, with its decision being final and binding.

Concurrently, the Department of Agriculture notified the "Interest subsidy on Loans for Agriculture and Allied Activities" scheme on 25th August, 2025, which became operative for a period of three years from 1st April, 2025, to 31st March, 2028. This scheme provides a 4% interest subsidy to farmers who promptly repay their loans, covering short-term crop loans up to Rs. 3 lakhs and agriculture term loans up to Rs. 5 lakhs. It applies to all talukas of the State of Goa and includes eligibility for Krishi card and Kisan Credit Card (KCC) holders. Furthermore, the Department of Agriculture also notified the "Special Agriculture Awards" and "State Agriculture Awards" schemes on 19th September, 2025. These awards, including the "Krishi Ratna" (a lifetime achievement award) and the "Fr. Inacio Almeida Annual Award" for organic farming, recognize outstanding farmers with cash awards and citations for their innovative practices and contributions to agricultural productivity.

In administrative developments, the Department for Empowerment of Persons with Disabilities issued three orders on 31st October, 2025. These orders sanctioned the creation of new regular posts, including Deputy Director and Assistant Director positions, and the transfer of existing posts such as State Coordinator and Head Clerk from the Directorate of Social Welfare. These changes culminated in the finalization of the Department's sanctioned staff strength, comprising 30 posts, aimed at strengthening its operational capacity. Additionally, the Department of Home issued an Office Memorandum on 7th November, 2025, addressing the procedure for recruitment in cases where suitable ex-servicemen candidates are unavailable for Group 'C' posts. The new procedure allows such vacancies to be filled by meritorious candidates from other categories during the same recruitment process, with the condition that an equivalent number of vacancies will be earmarked for the ex-servicemen category in the subsequent recruitment year. The Department of Personnel also notified new Recruitment Rules for the Office of the Inspector General of Prisons on 5th November, 2025, superseding previous rules for Male Nurse/Female Nurse posts and regulating recruitment for Group 'C', Non-Gazetted, Non-Ministerial positions.

Similarly, the "Special Agriculture Awards" and "State Agriculture Awards" schemes are designed to motivate and recognize the efforts of self-cultivating farmers, encouraging the adoption of innovative and best practices to improve productivity. The administrative restructuring within the Department for Empowerment of Persons with Disabilities aims to create a robust and dedicated institutional framework to effectively serve persons with disabilities, addressing any previous limitations in staffing or organizational clarity. The revised recruitment procedure for ex-servicemen seeks to balance the reservation policy with the practical necessity of filling critical vacancies, ensuring that government services are not hampered while maintaining a commitment to ex-servicemen welfare. The new Recruitment Rules for the Inspector General of Prisons streamline the hiring process for specific posts, ensuring transparency and efficiency in public service appointments.
