Haryana Amends Urban Areas Act to Streamline Development Certificate Procedures

The Haryana Development and Regulation of Urban Areas (Amendment) Act, 2024, an amendment Act passed by the Legislature of the State of Haryana, received the assent of the Governor of Haryana on December 3, 2024. This legislation was subsequently published for general information via a notification dated December 18, 2024. The Act aims to further modify the Haryana Development and Regulation of Urban Areas Act, 1975, and notably, it is deemed to have come into force retrospectively from January 30, 1975.

The amendment introduces several new definitions into Section 2 of the principal Act. A "completion certificate" is now defined as a certificate granted by the Director upon the conclusion of development works across an entire colony, adhering to sanctioned layout plans, building plans, and approved designs and specifications, and contingent upon the payment of prescribed fees and charges. The Act also defines an "occupation certificate" as a document issued by the Director that permits the occupation of any building or a portion thereof. Furthermore, a "part completion certificate" is introduced, signifying a certificate granted by the Director after the completion of development works in a specific part of a colony, in accordance with sanctioned layout plans and approved designs and specifications.

A significant change is effected in Section 3 of the principal Act with the insertion of a new sub-section (8). This provision addresses the process for granting completion certificates, particularly for colonizers (developers of colonies). It stipulates that in situations where a colonizer has already secured an occupation certificate for all building blocks in non-plotted colonies, or a part completion certificate for an entire plotted colony, additional scrutiny for the purpose of issuing a completion certificate will no longer be required. Such a completion certificate can then be issued simply upon the payment of applicable infrastructure augmentation charges. This amendment directly impacts developers, urban planning authorities, and residents within urban areas regulated by the Act.

The legislative intent behind the Haryana Development and Regulation of Urban Areas (Amendment) Act, 2024, appears to be the streamlining of regulatory processes concerning urban development and construction. The earlier statutory framework, particularly regarding the issuance of completion certificates, may have presented procedural complexities or redundancies, especially when partial or full occupation had already been permitted. The core policy rationale is to facilitate smoother transitions from development to occupation by reducing unnecessary bureaucratic steps. The legislation provided: “Notwithstanding anything contained in sub-section (6) and (7) above, in cases where the colonizer has either obtained occupation certificate for all the building blocks in case of other than plotted colonies or where part completion certificate for the entire colony has been obtained in case of plotted colonies, no further scrutiny for the purpose of grant of completion certificate shall be necessary and such completion certificate may be issued upon payment of applicable infrastructure augmentation charges.” This provision effectively amends the existing process by removing the need for further scrutiny in specific, well-defined scenarios, thereby potentially accelerating the finalization of development projects. The amendment introduces a new obligation for colonizers to pay "applicable infrastructure augmentation charges" to avail of this streamlined process, ensuring that necessary infrastructure development costs are still covered. This legislative change aims to foster more efficient urban development while maintaining regulatory oversight through the initial grant of occupation or part completion certificates.
