Haryana Legislative Assembly Members to Receive Enhanced Financial Advances

The Haryana Legislative Assembly (Facilities to Members) Second Amendment Act, 2025, an amendment to the Haryana Legislative Assembly (Facilities to Members) Act, 1979, was enacted to further update and enhance the financial provisions available to the state's legislators. The Act received the assent of the Governor of Haryana on September 9, 2025, and was subsequently published for general information on September 12, 2025, thereby coming into force. This legislative instrument introduces significant changes to the facilities extended to Members of the Haryana Legislative Assembly, primarily by substituting the existing Section 3 of the principal Act. Alternatively, the advance could be used for the purchase of a motor car, or for a combination of both housing and motor car acquisition. The legislation provided: “Subject to such conditions and limitations, as may be prescribed, an amount not exceeding one crore rupees may be paid to each member as repayable advance, (i) a house building advance for the purchase of a built up house or flat or for building a house or flat to be constructed by the Co-operative Group Housing Society of which he is a member; or (ii) for the purchase of a motor car; or (iii) for clauses (i) and (ii) both:” The Act also detailed specific conditions and limitations for drawing these advances, particularly when a member sought to draw multiple advances or a combination of house building and motor car advances. For instance, if a member had already drawn a motor car advance less than the one crore rupee limit, they became eligible to draw the remaining amount as a house building advance. Similarly, provisions were made for drawing house building or motor car advances for a second or even third time, subject to the repayment of the principal amount along with interest and after accounting for any previously drawn advances within the one crore rupee ceiling. A member became eligible to draw a motor car advance two times during a single tenure of the Haryana Vidhan Sabha, which typically spans five years or less. In addition to the one crore rupee advance, the Act also entitled members to draw an amount up to ten lakh rupees for effecting major repairs, additions, or alterations to their houses, specifying that this amount would be supplementary to the primary one crore rupee advance.

The legislative intent behind this amendment was to address the evolving financial needs of the Members of the Haryana Legislative Assembly, ensuring they have adequate support for essential assets like housing and transportation. The earlier legal position, governed by the 1979 Act, likely had lower limits for such advances, which may have become insufficient over time due to inflation and rising costs of living and property. By substituting Section 3, the Act aimed to bridge these statutory gaps and limitations, providing a more robust and flexible financial framework. The significant increase in the advance amount and the detailed conditions for its utilization reflect a policy rationale to facilitate members in maintaining suitable living standards and mobility necessary for their public duties. The amendment introduces new entitlements and obligations, particularly regarding the repayment of these advances and the conditions for subsequent draws. While the Act itself does not detail specific enforcement mechanisms beyond the general administrative procedures for disbursing and recovering government advances, it lays down the statutory basis for these enhanced facilities.
