The Haryana Management of Civic Amenities and Infrastructure Deficient Municipal Areas (Special Provisions) Amendment Act, 2025, an amendment to the Haryana Management of Civic Amenities and Infrastructure Deficient Municipal Areas (Special Provisions) Act, 2016, received the assent of the Governor of Haryana on September 11, 2025. The Act was subsequently published for general information on December 5, 2025, thereby coming into force upon its publication in the Official Gazette. This legislative instrument was enacted to further refine the existing framework governing civic amenities and infrastructure in municipal areas across the state.
The Amendment Act introduces several new definitions into the principal Act. These include "development agency," which refers to an agency notified by the Government, and "Director," specifically identifying the Director of the Urban Local Bodies Department. The terms "entrepreneur" and "enterprise" are also defined, aligning their meanings with those assigned in the Haryana Enterprises Promotion Act, 2016. Crucially, the Act defines "unauthorized development" as any area developed in contravention of provisions outlined in various state laws, such as the Haryana Municipal Act, 1973, the Haryana Municipal Corporation Act, 1994, and the Haryana Development and Regulation of Urban Areas Act, 1975, among others. Similarly, an "unauthorized plot" is defined as an area sub-divided in contravention of section 7 of the Haryana Development and Regulation of Urban Areas Act, 1975. A significant new provision, Section 5A, has been inserted to address the regularisation of unauthorized industrial establishments. The legislation provided: “In case of regularisation of unauthorized industrial establishment, an online portal for receiving applications from entrepreneur/enterprise shall be created and all punitive action initiated against the applicant(s) shall be deemed to have been suspended from the date of submission of the application on the portal until the Government takes a final decision, except in cases forwarded to or pending before any court of law.” This provision aims to offer a structured pathway for industrial units operating without requisite permissions to achieve compliance. Furthermore, Section 6A has been added, stipulating that roads and streets depicted in the layout plan of a declared area shall vest with the municipality as public streets. Section 6B grants the Government control over the efficient administration of the Act through the Director, who is mandated to execute directions issued from time to time. The Act also omits Clause (e) of Section 9 of the principal Act.
The legislative intent behind these amendments is to enhance the clarity, administrative efficiency, and governance of urban areas, particularly concerning civic amenities and industrial development. By introducing precise definitions for terms like "development agency," "unauthorized development," and "unauthorized plot," the Act addresses previous statutory ambiguities and provides a more robust legal framework for urban planning and management. The policy rationale behind establishing a regularisation process for unauthorized industrial establishments is to integrate such units into the formal economy, thereby promoting ease of doing business and ensuring compliance with regulatory standards. This mechanism also offers a temporary suspension of punitive actions for applicants, encouraging formalisation. The amendments aim to streamline urban development by clarifying the ownership and management of public infrastructure, such as streets, which now vest with municipalities. Moreover, the provisions strengthen the government's oversight and control through the Urban Local Bodies Department, ensuring effective implementation and administration of the Act's provisions to improve civic amenity provision and infrastructure management in deficient municipal areas.
