Indian Railways Modifies Promotion Eligibility for Prosecution Cadre Officers

The Ministry of Railways, through a notification issued on October 7, 2025, introduced the Indian Railways Prosecution Cadre (Group A and B Gazetted posts) Amendment Rules, 2025. These rules, enacted by the President in exercise of powers conferred by the proviso to Article 309 of the Constitution, came into force on the date of their publication in the Official Gazette. The amendment specifically targets the Indian Railways Prosecution Cadre (Group A and B Gazetted posts) Recruitment Rules, 2022, altering the criteria for promotion within the cadre.

The primary change introduced by the 2025 Amendment Rules concerns the eligibility service required for promotion to the post of Assistant Legal Officer (Prosecution). Previously, the eligibility service period was six years. This has now been revised to eight years. The amendment also renumbered the existing 'Note' in the Schedule against serial number 1 as 'Note 1' and inserted a new 'Note 2'. This new provision clarifies the position for existing personnel, stating that the eligibility service for promotion shall continue to be six years for individuals holding a post on a regular basis on the date of the notification of these rules. The legislation provided: “for the words "six years", the words "eight years" shall be substituted;... "Note 2: The eligibility service for promotion shall continue to be six years for persons holding post on regular basis on the date of notification of these rules."” This modification directly impacts officers within the Indian Railways Prosecution Cadre aspiring for promotion to Assistant Legal Officer (Prosecution).
