Karnataka Government Notifies Recruitment Rules for ESI Medical Services

The Government of Karnataka recently issued the Karnataka Employees State Insurance Scheme (Medical) Services (Recruitment) Rules, 2025, a significant piece of delegated legislation aimed at streamlining the recruitment process for various positions within the state's Employees State Insurance (ESI) medical framework. These rules were formally notified on May 31, 2025, following a public consultation process. The draft of these rules had been published on May 13, 2025, in the Karnataka Gazette, inviting objections and suggestions from affected persons, which were subsequently considered by the State Government. The new rules came into force upon their publication in the Official Gazette.

The primary objective behind the promulgation of these rules is to establish a clear, comprehensive, and updated statutory framework for the recruitment and appointment of personnel across the Karnataka Employees State Insurance Scheme (Medical) Service. This initiative seeks to ensure that the ESI medical facilities are adequately staffed with qualified professionals, thereby enhancing the delivery of healthcare services to insured persons and their families. The legislation addresses the need for a revised legal position concerning recruitment, replacing previous notifications and rules that may have become outdated or insufficient to meet current administrative and service requirements.

The new rules, enacted under the powers conferred by sub-section (1) of section 3 read with section 8 of The Karnataka State Civil Services Act, 1978, explicitly repeal the Karnataka Employees State Insurance Scheme (Medical) Services (Recruitment) Rules, 2007. However, a crucial savings clause ensures that any previous operation of the repealed rules, or anything duly done or suffered thereunder, as well as any rights, privileges, obligations, or liabilities already acquired, accrued, or incurred, remain unaffected. The core of the legislation is detailed in its Schedule, which outlines 53 distinct categories of posts within the ESI Medical Service, ranging from medical and administrative roles to technical and support staff. For each category, the Schedule specifies the number of posts, the method of recruitment (which includes direct recruitment, promotion, deputation, and posting), and the minimum qualifications required. The legislation provided: “In suppression of Notification No. LD 176 LSI 2006, dated: 7th December 2007 the establishment of The Karnataka Employees State Insurance Scheme (Medical) Service in the Karnataka State Civil Services shall consist of each category of posts carrying scale of pay specified in column (2) of the schedule below, the number of posts, method of recruitment and the minimum qualification, if any, shall be as specified in the corresponding entries in column (3), (4), (5) and (6) thereof.” This provision highlights the intent to supersede previous recruitment norms and consolidate them into a single, authoritative document. Key positions such as Commissioner for ESIS, Deputy Director, Medical Superintendent, Senior Specialist, Insurance Medical Officer, Assistant Dental Surgeon, and various paramedical and administrative roles are covered, with detailed eligibility criteria including specific degrees, diplomas, registrations with medical councils, and requisite years of service for promotion. For instance, the rules specify that 751 Insurance Medical Officer positions will be filled by direct recruitment, requiring an MBBS degree and registration with the Medical Council of India or Karnataka Medical Council. Similarly, 752 Nursing Officer positions are designated for direct recruitment, requiring a diploma in General Nursing and registration with the Karnataka Nursing Council. The rules also define promotion pathways for many cadres, often requiring a minimum period of service in the feeder post, with provisions for considering officials with slightly less experience if no suitable candidates with the full required service are available. The comprehensive nature of these rules aims to provide clarity and transparency in the recruitment process, ensuring that the ESI Medical Services are staffed efficiently and effectively to serve the public.
