Kerala Amends Service Rules to Simplify Special Casual Leave for Employees with Challenged Children

The Government of Kerala has issued the Kerala Service (First Amendment) Rules, 2025, a significant piece of delegated legislation aimed at easing administrative burdens for its employees. These rules, published as S. R. O. No. 14/2025 in the Kerala Gazette Extraordinary on January 6, 2025, came into force immediately upon their publication. The amendment specifically targets the procedure for availing Special Casual Leave by government employees who have physically or mentally challenged children, addressing a long-standing issue of procedural complexity. The Finance (Rules-B) Department, acting under the powers conferred by sub-section (1) of section 2 read with section 3 of the Kerala Public Services Act, 1968, promulgated these rules.
The primary objective behind this amendment is to simplify the process for employees seeking Special Casual Leave (a type of leave granted for specific purposes beyond regular casual leave) for their challenged children. Previously, Rule 20 under Section II - Special Casual Leave in Appendix VII of Part I of the Kerala Service Rules mandated that employees produce a fresh medical certificate from a medical officer attending the child on each occasion they applied for this leave. This requirement, while ensuring authenticity, inadvertently created "unnecessary hardship" for employees, as noted in the Explanatory Note accompanying the notification. The new rules amend Rule 20 by substituting the phrase ", on each occasion of the leave" with a provision that allows for the re-use of a medical certificate within the same calendar year. The legislation provided: ". The employee shall produce such certificate as and when the leave is required and copy of the same can be used for the purpose in the same calendar year." This change means that once an employee obtains a medical certificate stating their child is physically or mentally challenged, a copy of that same certificate can be utilized for all subsequent applications for Special Casual Leave within that calendar year, eliminating the need to procure a new certificate every time leave is sought.
The legislative intent behind the Kerala Service (First Amendment) Rules, 2025, is rooted in a policy rationale to alleviate administrative difficulties faced by government employees. The earlier legal position, which necessitated repeated production of medical certificates, presented a practical challenge for parents who already manage the demanding care of children with special needs. This statutory gap led to avoidable bureaucratic hurdles and stress. By allowing a single certificate to suffice for an entire calendar year, the government aims to streamline the process, thereby reducing the frequency of visits to medical officers solely for certification purposes and minimizing paperwork. This amendment does not introduce new rights or obligations but rather modifies an existing procedural requirement within the Kerala Service Rules. The rules came into force at once, ensuring immediate relief to the affected employees.
