Kerala Amends Service Rules to Simplify Special Casual Leave for Employees with Disabled Children

The Government of Kerala, through its Finance (Rules-B) Department, issued the Kerala Service (First Amendment) Rules, 2025, a significant piece of delegated legislation. This notification, G.O. (P) No. 1/2025/Fin. and S. R. O. No. 14/2025, dated January 1, 2025, was made in exercise of powers conferred by sub-section (1) of section 2 read with section 3 of the Kerala Public Services Act, 1968. The new rules came into force immediately upon their publication in the Official Gazette on January 6, 2025. The primary objective of these rules is to amend Part I of the Kerala Service Rules, specifically targeting the provisions related to Special Casual Leave for employees with physically or mentally challenged children. The amendment introduces a streamlined procedure for availing this leave, directly impacting numerous government employees across the state.

The core change introduced by the Kerala Service (First Amendment) Rules, 2025, involves a modification to Rule 20 under 'Section II - SPECIAL CASUAL LEAVE' in Appendix VII of Part I of the Kerala Service Rules. Previously, employees were required to produce a medical certificate "on each occasion of the leave" when applying for Special Casual Leave for their children with disabilities. This requirement often led to administrative difficulties and undue hardship for the affected employees. The amendment substitutes this phrase with a new provision designed to simplify the process, ensuring that the necessary documentation is less burdensome while still maintaining accountability.

The legislative intent behind this amendment was to address a practical issue faced by government employees who are parents of physically or mentally challenged children. An explanatory note accompanying the notification clarified that the earlier legal position, which mandated the repeated production of medical certificates for each instance of Special Casual Leave, was identified as a source of "unnecessary hardship" for these employees. The Government of Kerala recognized this statutory gap and sought to introduce a more compassionate and efficient framework. The amendment aims to simplify the procedure for availing Special Casual Leave, thereby easing the administrative burden on employees without compromising the integrity of the leave provision. This policy rationale underscores a commitment to supporting employees in managing their family responsibilities, particularly those involving special care needs.

The amendment effectively resolves the issue of repetitive documentation by allowing a single certificate to be utilized for an entire calendar year. The legislation provided: ". The employee shall produce such certificate as and when the leave is required and copy of the same can be used for the purpose in the same calendar year." This change means that once an employee provides a medical certificate confirming their child's condition, a copy of that same certificate can be used for all subsequent Special Casual Leave applications within that calendar year, eliminating the need to obtain a fresh certificate for each leave period. This measure is expected to significantly reduce the procedural hurdles for employees, allowing them to focus more on their children's care rather than administrative formalities. The amendment does not introduce new rights but rather streamlines the exercise of an existing entitlement, reflecting a responsive approach to the practical challenges faced by its workforce.
