Ladakh Establishes Procedure for Domicile Certificate Issuance for Civil Services Recruitment

The President of India recently issued the Ladakh Civil Services Decentralization and Recruitment-Grant of Domicile Certificate (Procedure) Rules, 2025, a significant piece of delegated legislation aimed at streamlining the process for obtaining domicile certificates within the Union territory. These rules, notified by the Ministry of Home Affairs on June 3, 2025, came into force immediately upon their publication in the Official Gazette. The new rules define "Competent Authority" as the Tehsildar within their territorial jurisdiction, or any other officer as may be notified by the Administration, for the purpose of issuing these certificates. A "Domicile Certificate" is specifically designated for appointments to any post under the Union territory of Ladakh, as defined in the overarching Ladakh Civil Services Decentralization and Recruitment (Amendment) Regulation, 2025, under which these rules are framed.
The rules outline a comprehensive application process, allowing eligible individuals to apply to the Competent Authority either physically or electronically, using a format to be prescribed by the Administration of Ladakh. For minors and persons with disabilities, applications and related actions may be undertaken by their parents or guardians. Each application must be accompanied by specific documents tailored to various eligibility categories. These categories include holders of a Ladakh Resident Certificate (L.R.C.) or those eligible for it, children of such persons, and children of Ladakh residents who resided outside the Union territory for employment or business. Crucially, the rules also establish eligibility for individuals who have resided in Ladakh for a period of fifteen years, providing for documentation such as Ration Cards, immovable property records, educational records, voter lists, utility bills, or employer certificates verified by relevant authorities, all indicating residence from October 31, 2019, the date of the Union territory's formation. Another category covers persons who have studied for seven years and appeared for their 10th or 12th examination in an educational institution located in Ladakh, requiring educational certificates verified by the Chief Education Officer. The Competent Authority, after conducting necessary inquiries based on the furnished documents, is empowered to either issue or reject the Domicile Certificate. The legislation provided: “The format shall clearly mention that the domicile certificate is valid only for the purpose of appointment to the posts under the Union territory of Ladakh as defined in Ladakh Civil Services Decentralization and Recruitment (Amendment) Regulation, 2025.” This ensures clarity regarding the certificate's specific utility.
These rules were enacted to provide a clear and structured framework for the grant of Domicile Certificates, addressing the procedural gaps that might have existed in the absence of such detailed guidelines. The legislative intent is to facilitate the decentralization of civil services and recruitment processes within Ladakh, ensuring that eligible residents can readily obtain the necessary documentation for local employment opportunities. By defining specific eligibility criteria and the corresponding documentary evidence, the rules aim to bring transparency and uniformity to the process. The establishment of the Tehsildar as the primary Competent Authority and the Deputy Commissioner as the Appellate Authority introduces a clear chain of command and an effective grievance redressal mechanism. Any person aggrieved by an order of the Competent Authority may file an appeal before the Appellate Authority, which is mandated to provide an opportunity of being heard to the parties involved. Furthermore, the Appellate Authority holds revisionary powers, allowing it to suo motu (on its own motion) or upon application, review the legality and propriety of proceedings or orders made by any Competent Authority, again with a provision for a reasonable opportunity of being heard. For any questions regarding the interpretation of these rules, the matter is to be referred to the Administrator of the Union territory of Ladakh for a definitive decision. These provisions collectively aim to create a robust and fair system for determining domicile status for the purpose of public employment in Ladakh.
