Ministry of Railways Appoints Competent Authorities and Arbitrators for Special Railway Projects in Bagalkot

The Ministry of Railways, through the South Western Railway Construction Organisation, issued a formal notification on September 4, 2025, to designate specific administrative officials for land acquisition duties related to infrastructure development in Karnataka. This notification, identified as S.O. 4058(E), was issued under the statutory framework of the Railways Act, 1989. The measure aimed to facilitate the construction of essential railway infrastructure by appointing a Competent Authority and an Arbitrator to manage the legal and administrative requirements of land procurement for public purposes. The notification specified that these appointments would take effect from the date of its publication in the Official Gazette.

The legislative action focused on two major Special Railway Projects (infrastructure projects of national or regional importance designated by the government) within the Gadag - Hotgi Section, both situated in the Bagalkot district. The first project involved the construction of a Road Over Bridge (ROB) in lieu of Level Crossing No. 41, featuring a 1x30.00-meter railway span with a bow string girder and associated approaches on the Sankeshwar - Kudalasangama (SH-44) Road. The second project entailed the construction of an ROB in lieu of Level Crossing No. 34 on the Bagalkot - Badami (SH-57) Road, which included a 1x60.00-meter railway span. These projects utilized specialized engineering components, such as Prestressed Concrete (PSC) girder spans and U-trough retaining walls, to enhance the safety and efficiency of the regional transport network.

The legislation provided: “In the exercise of the powers conferred by clause (6) of section 20F and clause 7A of section 2 of the Railway Act, 1989 (24 of 1989) the Ministry of Railway (South Western Railway, Construction Organization, Bengaluru Cantonment) hereby authorizes the officers mentioned at column (4) in the table below as Competent Authority and the officers mentioned at column (5) in the table below as Arbitrator to perform the functions as such authority under the said act”

The policy rationale behind this notification was to ensure a structured legal mechanism for the acquisition of land, which is a prerequisite for the execution of railway infrastructure. Under the designated statutory framework, the Assistant Commissioner of Bagalkot was authorized to function as the Competent Authority, the official responsible for overseeing the initial land acquisition process and determining compensation. Simultaneously, the Regional Commissioner of Belgaum was appointed as the Arbitrator, the authority tasked with resolving disputes regarding compensation or other acquisition-related grievances. This arrangement addressed the statutory requirement for clear enforcement mechanisms and administrative oversight in the transition from level crossings to road over bridges. By substituting hazardous level crossings with modern bridge structures, the Ministry sought to mitigate traffic congestion and improve safety standards on State Highways 44 and 57. The notification effectively streamlined the transition from the earlier statutory framework to the active implementation phase of these infrastructure improvements, ensuring that the land acquisition process adheres to the procedural requirements of the Railways Act.
