The Ministry of Railways, through the South Western Railway, issued a statutory notification on January 9, 2025, to facilitate the development of critical infrastructure across several districts in Karnataka. The notification, identified as S.O. 158(E), was issued in exercise of the powers conferred by the Railways Act, 1989, specifically under provisions relating to the appointment of officials for "Special Railway Projects." This legislative instrument designated specific administrative officers to serve as Competent Authorities and Arbitrators for eight distinct projects involving the construction of Road Over Bridges (ROB) and Road Under Bridges (RUB). These projects are situated at various level crossings within the districts of Mandya, Mysore, Shivamogga, Tumkur, and Chikkamagaluru. The notification came into force immediately upon its publication in the Official Gazette, providing the legal basis for the designated officers to perform their statutory functions.

The legislation provided: “the central government hereby authorizes the officers mentioned in column (4) of the table below as Competent Authority and the officers mentioned in column (5) of the table below as Arbitrator to perform the functions as such authority under the said act with effect from date of publication of this notification in the official gazette in respect of Special Railway Projects mentioned in column (2) relating to district mentioned in column (3) of the table below for public purpose of execution, maintenance, management and operation of such Special Railway Project.”

The policy rationale for this notification is rooted in the necessity to streamline the execution, maintenance, and management of railway infrastructure intended for public use. By invoking Section 20F and Section 2 of the Railways Act, 1989, the government established a clear administrative hierarchy to handle the legal and procedural aspects of land-related matters and dispute resolution. A Competent Authority (an official authorized to perform functions related to land acquisition and compensation) and an Arbitrator (a high-ranking official appointed to resolve disputes regarding compensation awards) are essential for the lawful progression of these projects. For example, in the Mandya district, the Assistant Commissioner of Mandya was appointed as the Competent Authority for the construction of a Road Over Bridge at Srirangapatna-Pandavapura, while the Regional Commissioner of Bengaluru was designated as the Arbitrator.

This statutory framework addresses the need for localized oversight in infrastructure development. In Shivamogga, the Assistant Commissioner was authorized to oversee the construction of Road Under Bridges at Bhadravati and Anandapuram. Similarly, in Tumkur, the Special Land Acquisition Officer for the Tumkur-Raydurga Railway Project was tasked with managing multiple Road Over Bridge constructions at Nidvanda and Kyatsandra. These appointments ensure that the statutory gaps in project management are filled by officials with the requisite local jurisdiction and administrative power. By defining these roles and the specific geographical areas of their responsibility, the notification ensures that the transition from project planning to the actual execution and operation of railway bridges remains compliant with the established legal requirements for public infrastructure projects.
