Ministry of Railways Notifies Competent Authority and Arbitrator for Mandya Special Railway Project

The Ministry of Railways, through the South Western Railway Construction Organisation, issued a formal notification on July 11, 2025, designated as S.O. 3098(E). This legislative instrument serves as a corrigendum to a previous notification, S.O. 158(E), which was originally issued on January 9, 2025. The notification was published in the Gazette of India on July 15, 2025, and came into force immediately upon its publication in the official gazette. The primary purpose of this issuance was to authorize specific administrative officers to perform statutory functions for a designated Special Railway Project in the state of Karnataka. The project involves the construction of a Road Over Bridge (ROB) in lieu of Level Crossing (LC) No. 97 at the Srirangapatna - Pandavapura section, specifically covering the Kiranguru and Rampura villages.

Under the provisions of the notification, the Assistant Commissioner of Pandavapura was appointed as the Competent Authority (an official designated to perform functions related to land acquisition and administrative oversight) for the project. Simultaneously, the Regional Commissioner of the Mysore Division in Mysore was designated as the Arbitrator (a quasi-judicial authority appointed to resolve disputes, particularly those concerning compensation amounts). These appointments were made to facilitate the public purpose of execution, maintenance, management, and operation of the railway infrastructure within the Mandya district. By identifying these specific officers, the Ministry ensured that the administrative machinery was properly aligned with the geographical requirements of the project.

The legislative intent and policy rationale behind this notification were rooted in the necessity to provide a clear and functional statutory framework for infrastructure development under the Railways Act, 1989. The notification addressed the requirement for localized oversight in land-related matters, ensuring that the legal rights of affected persons and the operational needs of the railway are managed through established statutory channels. The legislation provided: “In the exercise of the powers conferred by clause (6) of section 20F and clause 7A of section 2 of the Railway Act, 1989 (24 of 1989) the Ministry of Railway (South Western Railway, Construction Organization, Bengaluru Cantonment) hereby authorizes the officers mentioned in column (4) of the table below as Competent Authority and the officers mentioned in column (5) of the table below as Arbitrator to perform the functions as such authority under the said act”

This administrative action corrected the earlier legal position established by the January 2025 notification, addressing specific statutory gaps or descriptive inaccuracies regarding the project’s chainage and the relevant authorities. By substituting the designated officials, the government ensured that the enforcement mechanisms and statutory timelines provided under the Railways Act could be effectively applied to the Mandya district. The notification reinforces the existing legal framework for Special Railway Projects, which allows for expedited infrastructure development while maintaining a structured process for arbitration and land management. This ensures that the construction of the Road Over Bridge can proceed with the necessary legal authorizations, ultimately aiming to improve safety and transport efficiency at the Srirangapatna - Pandavapura railway section.
