Mizoram Governor Notifies New Recruitment Rules for Public Service Commission Group 'B' and 'C' Posts

The Governor of Mizoram issued a notification on March 17, 2024, formally introducing The Mizoram Public Service Commission (Group 'B' & 'C') Recruitment Rules, 2025. These new rules, which constitute delegated legislation, came into force upon their publication in the Mizoram Gazette Extraordinary on March 19, 2025. The primary reason for their enactment was to supersede and replace the Mizoram Public Service Commission (Group 'B', 'C' & 'D' posts) recruitment Regulation, 1995, along with its subsequent amendment from 1999, and the Mizoram Public Service Commission (Group 'C' posts) recruitment Rules, 1994. This supersession aims to consolidate and update the regulatory framework governing appointments to various positions within the Mizoram Public Service Commission, while explicitly saving actions taken or omitted under the previous enactments.

The new rules apply to specific posts detailed in an annexed Schedule-I, including Assistant Grade, Upper Division Clerk, Data Entry Operator, and Lower Division Clerk. They meticulously outline the number of posts, their classification, and the corresponding level in the pay matrix. Furthermore, the rules specify the method of recruitment, age limits, and other essential qualifications for these positions. A significant provision, Rule 5, introduces a disqualification for individuals who have entered into or contracted a marriage with a person having a living spouse, or vice versa, for appointment to these posts. However, it includes a proviso allowing the State Government to grant exemptions if such a marriage is permissible under personal law and other valid grounds exist. The legislation provided: "In exercise of the powers conferred by the proviso to article 318 read with article 309 of the Constitution, and in supersession of the Mizoram Public Service Commission (Group 'B', 'C' & 'D' posts) recruitment Regulation, 1995 notified in the Mizoram Gazette extraordinary issue No. 64, dated 16.03.1995 and its subsequent amendment notified in the Mizoram Gazette extraordinary issue No. 118, dated 22.06.1999 and the Mizoram Public Service Commission (Group 'C' posts) recruitment Rules, 1994, notified in the Mizoram Gazette extraordinary issue No. 34, dated 30.03.1994, except as respects things done or omitted to be done before such supersession, the Governor of Mizoram hereby makes the following rules regulating the method of recruitment to the posts of Assistant Grade, Upper Division Clerk, Data Entry Operator and Lower Division Clerk under Mizoram Public Service Commission..."

The legislative intent behind these rules is to streamline and modernize the recruitment process for key administrative and clerical roles within the Mizoram Public Service Commission. The earlier legal position was characterized by fragmented regulations from 1994 and 1995, which likely presented statutory gaps and limitations in addressing contemporary requirements for public service. By superseding these prior enactments, the new rules aim to establish a unified, comprehensive, and transparent framework for recruitment. The policy rationale includes ensuring that candidates possess relevant skills, such as basic computer knowledge and Mizo Language Proficiency, which are now mandatory for several posts. For instance, Assistant Grade and Upper Division Clerk positions require a Bachelor's degree, basic computer knowledge, and a minimum score in a Mizo Language Proficiency test. Data Entry Operator and Lower Division Clerk roles also mandate specific computer certifications and typing speeds, alongside Mizo Language Proficiency. The rules also delineate the proportion of vacancies to be filled by direct recruitment, promotion, and Limited Departmental Examination (LDE), providing clear career progression paths for existing employees. For example, 50% of Assistant Grade and UDC posts are to be filled by promotion, while 30% are through direct recruitment. A two-year probation period is stipulated for direct recruits. The rules also include provisions for training and departmental examinations, a power for the Commission to relax certain provisions under specific conditions, and a saving clause to protect existing reservations and concessions for Scheduled Castes, Scheduled Tribes, and Ex-servicemen. Any questions regarding the interpretation of these rules will be decided by the Commission in consultation with the Department of Personnel & Administrative Reforms.
