National Consumer Disputes Redressal Commission Establishes New Recruitment Rules for Group 'C' Posts

The Ministry of Consumer Affairs, Food and Public Distribution (Department of Consumer Affairs) recently issued the National Consumer Disputes Redressal Commission (Group 'C' posts) Recruitment Rules, 2022, a significant piece of delegated legislation. These rules, published in the Official Gazette on June 30, 2022, came into force immediately upon their publication. For existing employees, the rules stipulate that incumbents of most specified posts who were appointed on a regular basis before the commencement of these rules shall be deemed to have been appointed under this new framework, with their continuous service being considered for promotion eligibility. A crucial provision addresses disqualification, stating that no person who has entered into or contracted a marriage with a person having a living spouse, or vice versa, shall be eligible for appointment, though the Central Government retains the power to grant exemptions under specific conditions. Furthermore, the Central Government, in consultation with the President of the NCDRC, may relax any provision of these rules for any class or category of persons if deemed necessary or expedient. The rules also explicitly save existing provisions for reservation, age-limit relaxation, and other concessions for Scheduled Castes, Scheduled Tribes, ex-Servicemen, and other special categories as per government orders.

For instance, an Upper Division Clerk requires a Bachelor's Degree, with recruitment split 40% by promotion and 60% by direct recruitment. Similarly, a Lower Division Clerk requires a 12th class pass and specific typing speeds. The legislation provided: “The method of recruitment, age-limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule.” This central provision underscores the comprehensive nature of the rules in governing all aspects of recruitment. The establishment of Departmental Confirmation Committees and Departmental Promotion Committees for various posts outlines the enforcement mechanisms for these new service conditions. These rules aim to create a stable and merit-based career progression path for the NCDRC's Group 'C' employees, contributing to the overall strength and operational effectiveness of the institution.
