New Rules Delineate Service Conditions and Administrative Procedures for Delhi Government Personnel

A new set of rules, published in the Gazette of India on Monday, July 7, 2025, has been issued to regulate the appointment and conditions of service for persons employed in various services and posts under the Government of National Capital Territory of Delhi (GNCTD). These rules, which came into force upon their publication, are designed to operationalize the framework established by the Government of National Capital Territory of Delhi (Amendment) Act, 2023 (19 of 2023), providing detailed procedures for administrative functions previously subject to varying interpretations. The legislation specifies the applicability of existing service rules to different cadres, including officers of All India Services (excluding the Indian Police Service), officers of the Delhi, Andaman and Nicobar Islands, Lakshadweep, Daman and Diu and Dadra and Nagar Haveli (Civil Service) (DANICS), and other Central Civil Services personnel serving in the GNCTD. A significant clarification provided by the rules states that for the purpose of any existing rule, regulation, or order, the term "State" or "State Government" shall be interpreted to mean the Ministry of Home Affairs.
The rules outline the process for the creation of posts within the GNCTD, stipulating that the Lieutenant Governor may exercise powers for creating Group A, B, and C posts, new services, Board-level posts, and engaging non-officials, subject to the prior approval of the Central Government. However, this prior approval is not required where such powers have already been delegated to the Lieutenant Governor. Furthermore, the legislation establishes the operational procedures for the National Capital Civil Service Authority (NCCSA), detailing how proposals are to be submitted, circulated, and deliberated upon. The Authority is mandated to meet within fifteen days of receiving an agenda, with its recommendations subsequently forwarded to the Lieutenant Governor. In instances where the Lieutenant Governor disagrees with the Authority's recommendations, the matter may be returned for reconsideration, and if the disagreement persists, the Lieutenant Governor's decision shall be final. The rules also delineate the procedures for transfers and postings of Indian Administrative Service (IAS) officers, DANICS officers, and other Group 'A', 'B', and 'C' officials, linking these actions to the provisions of section 45H of the principal Act. Disciplinary proceedings and the grant of prosecution sanction for Group 'A' officers (including AIS) and DANICS officers are to be conducted in accordance with section 45H and these rules, while for Group 'B' and 'C' officials, these actions are based on recommendations from the Directorate of Vigilance or the concerned Vigilance Officer. The Chief Vigilance Officer-cum-Chief Secretary is vested with general superintendence and control over the Directorate of Vigilance and Anti-Corruption Branch.
The legislative intent behind these rules is to provide a clear and comprehensive framework for the administration of services in the National Capital Territory of Delhi, addressing the policy rationale of ensuring efficient governance and accountability. The earlier legal position, which had led to administrative ambiguities regarding control over services, particularly after the enactment of the Government of National Capital Territory of Delhi (Amendment) Act, 2023, is now clarified through these detailed provisions. The rules aim to fill statutory gaps by explicitly defining the roles and powers of various authorities, including the Lieutenant Governor and the NCCSA, in matters of personnel management. The legislation provided: “The words "State" or "State Government" or "State Government concerned" or "Constituent States", wherever referred to in any rule, regulation, order, office order, circular, office memorandum, guideline, and such other matter shall mean the Ministry of Home Affairs in accordance with the Government of India (Allocation of Business) Rules, 1961;” This crucial clarification ensures a uniform interpretation of existing service rules within the GNCTD. The rules also specify that the Lieutenant Governor shall consult the Union Public Service Commission (UPSC) on all required matters under Article 320(3) of the Constitution, with all official correspondence regarding service matters to be conducted by or under the authority of the Chief Secretary or the concerned Department Secretary. Existing recruitment rules and other service-related regulations issued prior to the 2023 Amendment Act will continue to be in force unless amended, subject to the provisions of section 45H. For any residuary matters not covered by these rules, the Lieutenant Governor may issue orders with the approval of the Central Government, with Central Civil Services rules applying in the interim.
