New Rules Mandate Certified Engineers for Boiler Operations Across India

The Ministry of Commerce and Industry, through its Department for Promotion of Industry and Internal Trade, issued the Boiler Operation Engineers' Rules, 2025, which came into force on September 23, 2025, the date of their publication in the Official Gazette. These new rules, enacted in exercise of powers conferred by sub-section (1) read with clause (e) and clause (f) of sub-section (2) of section 39 of the Boilers Act, 2025, supersede the Boiler Operation Rules, 2021, marking a significant update in the regulatory framework governing boiler operations. The legislation provided: “The owner of a single boiler or two or more boilers connected in a battery or of many separate individual boilers situated within a radius of fifty meters having a total heating surface exceeding one thousand square meters in any of the cases shall not use the same or permit the same to be used unless the boiler or boilers are placed in direct charge of a proficient person specified in rule 4 in addition to such number of boiler attendants as specified in these rules.”

The rules detail the constitution of a Committee of Examiners at both State/Union Territory and Central Government levels, responsible for conducting examinations, granting certificates, and considering reports of inquiries. Eligibility criteria for candidates seeking a certificate of proficiency include a minimum age of twenty-three years, a bachelor's degree or diploma in specific engineering disciplines (Mechanical, Electrical, Chemical, Power, Production, Metallurgical, or Instrumentation Engineering), and a post-qualification experience ranging from two to five years, depending on the academic qualification, in the operation or maintenance of boilers of specified heating surface areas. The examination process comprises written papers, a drawing examination, and an oral examination, designed to assess practical ability and technical knowledge. Successful candidates receive a certificate of proficiency, valid across India until the holder attains sixty-five years of age. The rules also outline procedures for applying for examinations, the production of satisfactory testimonials, and provisions for dealing with false testimonials or the loss of certificates. Furthermore, a mechanism for inquiry into allegations of incompetence, drunkenness, misconduct, or negligence against certificate holders is established, allowing for the suspension or permanent cancellation of certificates.
