New Rules Mandate Stringent Standards for Vehicle Speed Radar Equipment

The Central Government, through the Ministry of Consumer Affairs, Food and Public Distribution (Department of Consumer Affairs), issued a significant notification on January 14, 2025, introducing the Legal Metrology (General) Amendment Rules, 2025. These new rules, designated as G.S.R. 34(E), were enacted in exercise of powers conferred by sub-section (1) read with clauses (c), (f), (h), (i) and (s) of sub-section (2) of section 52 of the Legal Metrology Act 2009. The amendment further modifies the existing Legal Metrology (General) Rules, 2011, and is set to come into force on July 1, 2025. The primary objective of this legislative action is to establish comprehensive metrological and operational standards for radar equipment used in measuring vehicle speed, thereby enhancing accuracy and reliability in traffic enforcement.
The amendment introduces a new "PART X" into the Eighth Schedule of the Legal Metrology (General) Rules, 2011, specifically addressing "RADAR EQUIPMENT FOR MEASURING SPEED OF VEHICLES." This new Part details the scope, rules of correct operation, construction requirements, and model approval procedures for microwave Doppler radar equipment employed for traffic speed measurement on roads. Key provisions within this Part mandate stringent conditions for certainty of vehicle identification, ensuring that indicated speeds are not wrongly attributed, even in complex traffic scenarios involving passing or overtaking vehicles. It also specifies requirements for aiming devices, radiation models of antennas, time span for speed indication, and the nature of recording devices, including the information they must capture such as date, time, measured speed, and vehicle direction. Special provisions are outlined for automatic and autonomous radar systems, demanding a "near to certainty" level of confidence in their performance.
The legislative intent behind these amendments is to fill a critical gap in the existing statutory framework by providing detailed technical and operational guidelines for speed measurement devices. The earlier legal position under the Legal Metrology (General) Rules, 2011, lacked specific provisions to regulate the accuracy, reliability, and operational integrity of radar equipment used for speed detection. This absence could lead to inconsistencies in enforcement and potential challenges regarding the veracity of speed measurements. The new rules aim to standardize these instruments, ensuring that they operate within permissible error limits and are resistant to tampering and environmental disturbances. The legislation provided: “Radars designed for operations that cannot be continuously verified by an officer for satisfactory performance shall ensure a "near to certainty" level of confidence that the error of each transmitted result shall be within the permissible limits.” This underscores the policy rationale of ensuring public trust in speed enforcement mechanisms by mandating a high degree of precision and reliability from the equipment.
The amendments introduce new obligations for manufacturers, requiring them to provide detailed instructions on the equipment's theory of operation, normal operating conditions, and principal causes of errors. They also mandate robust protection against tampering and clear identification of the equipment. A comprehensive model approval process is established, involving metrological tests in laboratories, evaluation of the effects of influence factors (such as power variations, electrical bursts, and electromagnetic fields), and practical metrological field tests under actual traffic conditions. These tests are designed to assess mechanical strength, climatic resistance, and the reliability of electronic and logical components, with specific criteria detailed in Annexure A. The overall framework seeks to ensure that all radar equipment used for speed measurement in India meets rigorous standards, thereby promoting fairness and accuracy in traffic law enforcement across the country.
