Odisha Amends Recruitment and Service Rules for Factories and Boilers Inspection Service

The Government of Odisha issued a notification on July 25, 2025, introducing the Odisha Factories and Boilers Inspection Service (Recruitment and Conditions of Service) Amendment Rules, 2025. These rules, enacted by the Governor of Odisha in exercise of powers conferred by the proviso to Article 309 of the Constitution of India, further amend the principal Odisha Factories and Boilers Inspection Service (Recruitment and Conditions of Service) Rules, 1984. The amendment rules came into force on July 28, 2025, the date of their publication in the Odisha Gazette. The phrase 'officers in the Class II rank' has been replaced with "Assistant Directors of Factories and Boilers," reflecting a modernization of official designations within the service. More significantly, the rules comprehensively revise SCHEDULE II, specifically PART I-LAW, which outlines the legal subjects for the examination. The previous list of laws has been entirely substituted with an updated and expanded curriculum. The legislation provided: “There will be one paper on the following laws and the examination shall be directed to test the general working knowledge of the important provisions of the Law-” This paper, designed to assess general working knowledge, now includes a broad spectrum of contemporary labour, industrial, and environmental legislation. The updated list encompasses 23 distinct Acts and Rules, ranging from foundational statutes like The Factories Act, 1948, and The Boilers Act, 1923, to more recent enactments such as The Environment (Protection) Act, 1986, The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, and the recently introduced Bharatiya Nyaya Sanhita, 2023, Bharatiya Nagarik Suraksha Sanhita, 2023, and Bharatiya Sakshya Adhiniyam, 2023. The examination structure for this paper specifies a written format with the aid of books, allowing only un-annotated editions of Acts issued by authority. Each paper will carry a maximum of 150 marks, with a duration of three hours, and candidates must secure 90 marks or above (60%) to pass.

The legislative intent behind these amendments is to ensure that officers recruited into the Odisha Factories and Boilers Inspection Service possess up-to-date knowledge of the complex and evolving legal landscape governing factories, boilers, and related labour and environmental safety standards. The earlier legal position, based on the 1984 Rules, would have relied on an outdated syllabus, potentially leading to a gap in the statutory knowledge of new recruits concerning recent legislative developments. The inclusion of new criminal laws like the Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and Bharatiya Sakshya Adhiniyam underscores a policy rationale to integrate broader legal reforms into the specialized knowledge required for these inspection roles, reflecting the comprehensive nature of legal compliance expected from such officers.
