Odisha Amends Recruitment Rules for Factories and Boilers Inspection Service, Updates Legal Syllabus

The Government of Odisha, through a notification issued by the Labour & E.S.I. Department on July 25, 2025, introduced the Odisha Factories and Boilers Inspection Service (Recruitment and Conditions of Service) Amendment Rules, 2025. These rules, enacted in exercise of powers conferred by the proviso to Article 309 of the Constitution of India, came into force upon their publication in the Odisha Gazette on July 28, 2025. The amendments modify the existing Odisha Factories and Boilers Inspection Service (Recruitment and Conditions of Service) Rules, 1984, aiming to update the framework governing the recruitment and service conditions of officers within the inspection service.

The primary changes introduced by the 2025 Amendment Rules include a revision in the designation of certain officers and a comprehensive update to the legal knowledge requirements for examinations. Specifically, sub-rule (1) of rule 23 of the principal rules was amended to substitute the phrase 'officers in the Class II rank' with "Assistant Directors of Factories and Boilers," thereby formalizing or updating the nomenclature for these positions. More significantly, the rules entirely replaced PART I-LAW of SCHEDULE II, which outlines the syllabus for examinations. The updated schedule mandates a single paper designed to assess candidates' general working knowledge of important provisions across a wide array of laws pertinent to industrial safety, labour welfare, and general legal administration.

The legislation provided: “PART-I LAW There will be one paper on the following laws and the examination shall be directed to test the general working knowledge of the important provisions of the Law-” This revised syllabus now encompasses 23 specific enactments, including foundational statutes such as The Factories Act, 1948, The Boilers Act, 1923, The Minimum Wages Act, 1948, and The Employee's Compensation Act, 1923. It also incorporates more recent legislation like The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, The Environment (Protection) Act, 1986, and The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. Notably, the updated list includes the recently enacted central criminal justice codes: Bharatiya Nyaya Sanhita, 2023; Bharatiya Nagarik Suraksha Sanhita, 2023; and Bharatiya Sakshya Adhiniyam, 2023. The examination structure specifies a written test with the aid of un-annotated editions of Acts, carrying a maximum of 150 marks over three hours, with a passing threshold of 90 marks (60%).

The legislative intent behind these amendments is to modernize the recruitment and service conditions for the Odisha Factories and Boilers Inspection Service, ensuring that officers possess a contemporary and comprehensive understanding of the legal landscape relevant to their duties.
