Parliament Amends Jammu and Kashmir Local Body Laws to Include OBC Reservation and Strengthen Election Machinery

The Jammu and Kashmir Local Bodies Laws (Amendment) Act, 2024, an Act of Parliament, received the assent of the President on February 12, 2024, and was subsequently published for general information. This legislative action was necessitated by the prevailing circumstances in the Union territory of Jammu and Kashmir, where the Legislative Assembly is not in existence. Consequently, the powers of the Legislature of the Union territory are being exercised by or under the authority of Parliament, as per the proclamation issued by the Government of India on October 31, 2019, under section 73 of the Jammu and Kashmir Reorganisation Act, 2019. The Act introduces significant amendments to three principal statutes governing local self-governance in the region: the Jammu and Kashmir Panchayati Raj Act, 1989, the Jammu and Kashmir Municipal Act, 2000, and the Jammu and Kashmir Municipal Corporation Act, 2000. The legislation is slated to come into force on a date to be appointed by the Central Government through a notification in the Official Gazette.

A central feature of the amendment is the explicit inclusion of "Other Backward Classes" (OBCs) for reservation in Panchayats, Municipalities, and Municipal Corporations. The legislation provided: '(la) "Other Backward Classes" means the Other Backward Classes declared by the Government of the Union territory of Jammu and Kashmir from time to time in accordance with sub-clause (iii) of clause (o) of section 2 of the Jammu and Kashmir Reservation Act, 2004;.' This definition is inserted into the Panchayati Raj Act and subsequently mirrored in the Municipal and Municipal Corporation Acts. Furthermore, the Act replaces outdated terminology in the Panchayati Raj Act, substituting "District Planning and Development Board" with "the District Development Council" and "District Panchayat Officer" with "Assistant Commissioner of Panchayat" throughout the statute. Similar terminological updates are made in the Municipal and Municipal Corporation Acts, replacing "Chief Electoral Officer" with "State Election Commission" and "Backward Classes" with "Other Backward Classes." The amendments also clarify and strengthen the powers and conditions of service for the State Election Commissioner, stipulating that the salary, allowances, and other conditions shall be determined by the Lieutenant Governor, with provisions for pension adjustments for retired government servants. The removal process for the State Election Commissioner is aligned with that of a High Court Judge, ensuring independence and security of tenure, and their service conditions cannot be varied to their disadvantage post-appointment. The State Election Commission's powers are enhanced to include issuing directions, delegating authority, and determining and delimiting municipalities. New grounds for disqualification in Panchayats may also be determined by the State Election Commission. Crucially, several provisions related to the State Election Commission from the Panchayati Raj Act are applied mutatis mutandis (with necessary changes) to the Municipal Act and the Municipal Corporation Act, ensuring a uniform and robust electoral framework across all local bodies.

The legislative intent behind the Jammu and Kashmir Local Bodies Laws (Amendment) Act, 2024, is primarily to ensure equitable representation for Other Backward Classes in the local self-governing institutions of the Union territory. Prior to this amendment, the statutory framework for local bodies in Jammu and Kashmir did not explicitly provide for reservation for OBCs, creating a significant gap in inclusive governance. The Act addresses this limitation by introducing specific provisions for OBC reservation in the composition of Panchayats, Municipalities, and Municipal Corporations, thereby aligning the local body laws with broader national policies on affirmative action. Beyond reservation, the legislation aims to streamline administrative structures by updating designations and consolidating the authority of the State Election Commission. The amendments to the State Election Commissioner's conditions of service and removal process are intended to bolster the independence and efficacy of the electoral machinery, which is vital for free and fair local elections. By applying key provisions of the Panchayati Raj Act concerning the State Election Commission to the Municipal and Municipal Corporation Acts, the legislation seeks to create a coherent and unified system for the conduct of local elections across different tiers of local self-governance. This comprehensive approach ensures that the local bodies in Jammu and Kashmir are not only more representative but also operate under a strengthened and independent electoral oversight mechanism.
