Parliament Integrates IIM Guwahati into IIM Act, 2017 Framework

The Indian Institutes of Management (Amendment) Act, 2025, an Act of Parliament, received the assent of the President on August 21, 2025, and was subsequently published for general information. This legislation was enacted to further amend the Indian Institutes of Management Act, 2017, primarily to bring the Indian Institute of Management, Guwahati, under the statutory framework of the principal Act. The core objective of the Indian Institutes of Management (Amendment) Act, 2025, is to formalize the legal status and governance of the Indian Institute of Management, Guwahati, by integrating it into the comprehensive statutory regime established by the Indian Institutes of Management Act, 2017. Prior to this amendment, IIM Guwahati may have operated without the full statutory backing and standardized governance structure afforded to other Indian Institutes of Management under the 2017 Act, creating a potential gap in its legal and administrative framework. The amendment addresses this by ensuring that IIM Guwahati is recognized as a body corporate, a legal entity with perpetual succession and a common seal, capable of suing and being sued. The legislation provided: “On and from the date of commencement of the Indian Institutes of Management (Amendment) Act, 2025, all the provisions of this Act shall apply to the Indian Institute of Management, Guwahati.” This ensures uniformity in the legal treatment and operational standards across all Indian Institutes of Management. Furthermore, the Act amends section 39 of the principal Act to provide for an interim arrangement, stipulating that until the first Board of the Indian Institute of Management, Guwahati, is constituted under the Act, all powers and functions of such Board shall be exercised and performed by a person or persons as directed by the Central Government. This mechanism ensures continuous and effective administration during the transitional phase. The Schedule to the principal Act has also been amended to formally include "Indian Institute of Management, Guwahati" at Sl. No. 22, under the state of Assam, thereby completing its statutory recognition. This legislative action underscores the policy rationale of providing a robust and consistent legal foundation for premier management education institutions across the country.
